My wife's I-485 and I765 (filed together) was rejected and returned due to a error on one of the forms. That's easy to fix but the I-797C Rejection Notice sent to me with my application also states that "your application package was submitted with a single remittance and one or more of the appication petitions were unacceptable in the package for the reason specified on the related NOA.

I submitted a check for $1,010 since my understanding is that this amount covers both the appication I-485 and I-765. So was I incorrect in the amount I sent or in sending only one check? Very confused. Any help would be appreciated.

It said in the I-485 instructions that you may submit one check or money order for both the application and biometric fees, for a total of $1010.00. Well, i guess the main reason for rejection is the error in one of the forms and they can't accept it. If you want to be sure make two separate checks of $930 for I-485 & I-765, and $80 for Biometrics. Both paid to US Department of Homeland security.

USCIS did wrong, Return it with the check for $1010.

Attach a copy of I-485 directions and highlight the following on page 7:

You may submit one check or money order for both the application and biometric fees, for a total of $1010.00

NOTE: Effective July 30, 2007, if you file Form I-485 to adjust your status as a permanent resident, no additional fee is required to also file an application for employment authorization on Form I-765 and/or advance parole on Form I-131. You may file these forms concurrently.

Your payment on I-485 was correct w/c is $1,010 but you don't have a check intended for I-765 w/c is EAD or working permit cost $340. The are separate payment on those 2 application.

Nope, both the EAD and Advanced Parole applications are covered in the new, revised I-485 $1,010 fees. :yes:

It's possible that what they're saying is that since your 485 was rejected and your payment is for the 485, with the 765 and 131 included in the fee, they cannot take the payment for the application that was not rejected.

Just starting the journey, haven't yet filed... Until today(2/12/07)!

you have to separate fee's for AOS and biometrics. follow the instructions of YuandDan

Instructions for I-485, Application to RegisterPermanent Residence or Adjust Status (Page 7.)

NOTE: Effective July 30, 2007, if you file Form I-485 to adjust your status as a permanent resident, no additional fee is required to also file an application for employmentauthorization on Form I-765 and/or advance parole on FormI-131. You may file these forms concurrently. If you chooseto file the I-765 and/or I-131 separately after the effective date, you must also submit a copy of your I-797C, Notice ofAction, receipt as evidence of the filing of an I-485.

Wrong, the $1010 covers I-765 and I-131, per the note I quoted from I-485 directions above.

Form I-765 needs to use code (c )(9 ) based on the I-485, NOT (a )( WHATEVER ) K-1 or Life act K-3.
