I am a k-3 filer. I have sent in the 130 (no NOA1 yet) and the 129F (got NOA1). So, now what happens? Seems a lot rides on when the 130 gets approved. If the 130 is approved well ahead of the 129f, then the USCIS seems to drop the 129F part and force you into CR1 process. If the 130 sits around unapproved then what happens to the 129F? Does it move along in the process or just sit in limbo until something happens with the 130?

I do get how this all works, so I'd like to better understand the interplay between the two petitions. The "cause and effect." I'm hoping that the 129F will move along so I can bring my wife over before the next ice age.

Thanks.

USCIS will send the I-129F on to NVC for K-3, and hold the I-130 for eventual adjustment of status from the K-3 visa. I have seen a few get K-3 visa while I-130 is still being processed, and also have seen speedy processing of the I-130 making the K-3 a costly choice.

I-130 by it self results in a GREEN-CARD visa called CR-1, NO adjustment of status needed, saving about $900 in fees.

http://www.uscis.gov/files/pressrelease/PN_i-129f.pdf (USCIS new policy on K-3) no more K-3 and CR-1 running at same time, it is either one or the other. If you want consular processing of the I-130 for CR-1 you need to file an I-824 after I-130 is approved, and pay an additional fee.

IF: you waited for the receipt between the two, and it was a long time, you should be concerned. I did send a cover letter explaining i wanted the K3 with the I130, so my filings went the way they should have. They were linked and properly processed.

You know they got both petitions because you mailed them in the same envelope. So, I would expect they are being processed together, even though you don't have any confirmation on the I-130.

I've never heard of USCIS holding the I-129F and forcing the CR1 route. The current policy is to approve both petitions together, then hold the I-130, effectively forcing the K3 route.
