Greetings all !!!!

We would like to ask for advice from others that have the K-3 visa.

My wife arrived here in Miami on a K-3 VISA last weekend. I know we must do the i-485 and EAD next,

but the $1010.00 fee will have to be saved up by us as we had alot of expenses getting my wife here.

Hopefully by next month we can come up with the money or wait for the income tax refund.....

In the mean time, I would like to know if we can get her social security number so I can file her on my income tax

return. Can I get the SSN now, before filing the I-485 ???

ANY advice is appreciated !!!! Thanks

K3 visa holders cannot get a SSN until they have EAD. However, you can file a W7 with the IRS, along with your next or amended tax return and get her an ITIN. (Individual Taxpayer ID number) Just download a W7 form with instructions from irs.gov

Hi there,

U won't be eligible for a SSN on a K-3 Visa initially. That is a another difference between the K1 and K3. K1 holders are eligible. Anyway, You will have to file your AOS along with the I-765 Application for Employment Authorization Document. Once you receive approval for 765 you can apply for a SSN. The approval may take 2-3 months. You may want to check with your local CIS office and see if you can file that form locally as opposed to filing it with the AOS documents. Be advised that you can file taxes without the SSN. You need to file for a ITIN (Individual Taxpayer Identification Number) using form W-7. http://www.irs.gov/individuals/article/0,,id=96287,00.html. U can use that number until you get an SSN for your wife.
