K3 recieved on passport with maiden name.

Timeline

My wife has already recieved her K3 visa a few weeks ago. We filed all her paperwork in her new name but since her canadian passport wasn't changed the visa was done with her maiden name.

We are still doing the CR-1 process and hope the interviewed is scheduled soon.

Before we have the CR-1 interview should we try to get her canadian passport changed to her new name? How will they go about transfering the visa if we do that?

08/29/2006 - NOA for I-130

02/24/2007 - Filed I-129

03/05/2007 - NOA for I-129

03/15/2007 - Transfer Notice for I-129 to VSC for processing

05/07/2007 - Transfer Notice for I-130 to CSC for processing

05/15/2007 - Receipt Notice for I-130 now pending at CSC

The visa won't be transferred and to change her name on the passport she will have to get a new passport.

If you feel strongly about her having her passport in her married name, then she can apply for a new one, however she will have to carry both the expired passport (with the visa stamp) and the new passport - the visa doesn't expire in other words (until it reaches its own expiry date).

In thinking about this now I am a bit confused about what you are asking. If she gets a new passport right away (before the CR1 interview) and they stamp her New passport with her New visa - I don't see the problem?

My concern is that when she goes for her CR1 interview she will get her green card and social security card in her maiden name and not her married name. We have no paperwork showing her married name anywhere.

I understand that part, I just don't understand the concern about the passport being stamped with the visa already - unless I am just reading it wrong and you mean she gets the passport in her married name after the CR1 interview.

Personally I would go right now and get the new passport - expedited - and just save a lot of hassle later on

I can't remember where I read it now, but I read recently that it isn't a problem if the visa is in the old passport. The visa has a life of its own in that it doesn't expire with the passport. Should be no problem carrying 2 passports, however since I assume they will be in different names you would, of course, need to carry your marriage certificate as well.

I got the visa and GC with maiden name - and got SSN card in married name. I have no plans on changing that since Mexico will not allow me to change my name as easy as Canada or the US would - will wait until AND IF I ever apply for US citizenship.

I don't think she'd be hassled at border - USCIS keeps records of all the names one has ever used (remember the forms?)

It will be difficult to get her name changed on her documents until her name is changed in her passport. They can't modify her existing passport? That's what my wife did.

Unfortunately Canadian passports can't be modified.
