I/ Package 3 sent 11/29/07, til now haven't received yet. Fiancé's house just few blocks away from HCMC. They said have to wait for 4 weeks then go to HCMC pick them up in person. What can we do? just wait for another two weeks? :luv:

II/ Should we mail package 3 back to HCMC or turn it in person?

III/ I have worked for this company since 2000. That time , because I didn't want uncle SAM take much money from my every pay check, therefore i filed in tax forms is married and exemption is 9. Now, in my pay stubs which we have to turn them in with I-134, it said tax status is married and exemption is 9. May this cause a red flag? I make 65K/year and claim 3 kids as my dependents. Do i have to get a single certification here then send it to my fiancée, just in case?

any advice appreciate guys

Hi,

Just my opinion on your questions:

I - If you already contacted the embassy and they told you to wait, most likely you have to wait, or you can have your fiancee bring her passport and her case number and maybe they will give her the packet 3. You can goto the window by the street at 4 Le Duan. It doesn't hurt to try, I guess.

II- I asked the same question, and my fiancee was able to get her packet 3 in the morning, fill it out at the IOM building, and return it to the embassy the same day. Some people reported that they could not return it and others have, it might be who is at the window that determines that, but its worth a try.

III - Are you saying you put married with dependents on your W-4 for the sole reason to have a lesser burden on your take home pay? Or are you, were you previously married? I'm not judging you, I'm just trying to understand your message. If you are worried that the CO will question that, possibly write a detailed letter of explanation, notarized and include it in your tax folder in the packet 4. Probably a good idea to include some pay stubs that show your true status.

I. I'm not sure if it works. And I will try soon. I have a copy of packet 3 (in Vietnamese). As they say it's mail out. I'll let my fiancee mail in (hand in person if it allows) next day.

#3 is a a huge red flag and possible why you have not got a packet yet. First, they might take it to mean your still married, in which case, it will be a deal breaker. Second, your committing Tax Fraud which is a punishable by huge fines and/or prison. This might be a deal breaker when they are considering your ability to provide support for someone. Kinda hard to provide for someone when your behind bars.

Your going to have MAJOR issues with #3. Essentially, you've committed tax fraud. Your going to have to resolve that issue before you can bring your fiancee over here. I wouldn't even file any financial paperwork with the consulate until it's cleared up. When they catch wind of this, they will likely notify the IRS. Your best bet is to start start with a tax attorney. You have a little leverage right now becuase you haven't been caught yet. You'll probably have a lot of back taxes and fines to pay. Call an attorney, fix this fast! Hope you saved some of that extra cash cause you're going to need it and more!

How did you file your taxes at the end of the year? Don't you have to put the SS# for your wife, even if you file separately?

Don't worry, maybe the gov't will bail you out like they helped the folks with the adjustable loans :)

Your status is on your pay stub? Are you sure? I've never seen one that has the number of exemptions on it and anyway it doesn't matterr how you claim exemptions through of the year as long as you pay up by end of April (there is a penalty if you underpaid by a certain percent, I never have so I'm not sure how much)

To answer your question, I also claimed married and 1 last year, because I'm head of household and 2, and at my income bracket the actual amount taken out was closer.

We've already done documents check and everything is OK, they dont care what you claim to have your employer take taxes and I don't think consular staff is bright enough to do the analysis (personal opinion).

Last years income tax return with last year's W2's, a letter from your employer that states your income and whether you are full/part time/contract, a letter from your bank showing total deposits last year, and a recent check stub should suffice for proof of income for you. Remember, the purpose of the I134 is to show that your fiance will not become a public burden, not to collect your documents and analyze your tax with-holding habits.

The rest of you stand down. It was an honest question and concern.

My Uncle claimed his dog for years! They are both dead, so there's not much they can do about it now.

I think it's fine to claim as many exemptions legally as you can. At the end of the year you'll ultimately paying the same amount of taxes. Better that you get all your money up front and not let Uncle Sam withold your money intrest free.

Don't worry about what you claim on your W-4 but what you actually end up paying the IRS for the past 8 years, got evidence to back them up? If you say YES then one less thing to worry.

However, Your concern is legit when it comes to HCMC! As "Alt name" suggested, most CO's don't waste their time to analyze people's tax documnets, may be in some cases, but I know for fact HCMC will analyze your Tax Return document. If you have been claimed for years "Married with 9 kids". You will have some explanation to address this information. HCMC has little to none tollerant when it comes to K-1/K-3 Visa and people with previous marriage. Have you been married? Are you currently married to someone? Anyone? Anywhere? If you say Yes, then you have bigger problem as AmericanGentlement suggested, "dealbreaker"!

In either case, claiming "married with 9 children" for tax purpose, or actually "married with 9 kids" will require you to provide a clear evidence that as of the day of your petition for her Visa, you were available to be married! (meaning, all previous marriages must be terminated and finalized, in other word: Divorced!)

Have fun with your journey and keep this near and dear to your heart: NEVER LOSE SIGHT OF THE BIG PICTURE! You're doing good by coming on VJ and asking all these questions. There are no stupid questions, just stupid answers!
