This topic brings one question to mind for me. Are proof of taxes going to be needed for the AOS interview? Or will they be going by what was submitted at the time of applying for the AOS?

For sure send last year's tax return, make sure the W2 is included. We missed to include the W2 and got a nice bright-pink RFE :crying:

When you go to your interview, they will have your entire, original file. Everything you have filed, and whatever else has been put there along the way from the original service center when you submitted your K-1, to NVC, to the embassy etc. And of course it will include everything you submitted for your AOS packet.

Kind of cool, kind of scary!

The advice from VJ is to bring EVERYTHING you have ever submitted, and it is good advice. But if you have followed the VJ guides from day one, then your file will already have everything. The VJ guide was also correct on what other types of supporting documents to bring to the interview that you don't necessarily submit with your AOS packet.

I forget what few things they actually did take from us at the interview, but it was not much. Proof of health and life insurance seemed a big thing at our interview, but other interviewers focus on other things. We were very glad our interview was a good experience, and most are.

Specifically regarding taxes, I submitted just the previous year of tax documents (with W2) for AOS. But the timing was such, for the K-1 tax information for the year before was submitted. I brought tax information for the three previous years, but the interviewer asked for none of it.

  • August 6, 2007 EAD card and Welcome Letter received!
  • August 13, 2007 GREEN CARD received!!! 375 days since mailing the I-129F!

    Remove Conditions:

  • May 1, 2009 first day to file
  • May 9, 2009 mailed I-751 to USCIS CS

They will have what you've submitted to that point but depending on when the AOS interview is (if you have one) or when it's processed (at CSC) you may need to bring more current or updated information, or submit to CSC in response to an RFE (if they feel they want updated or more current documentation). I was asked to provide the previous year's tax return at our AOS interview because another tax year had passed by that time, as well as an updated I-864 with my current income.

You will, of course, want to take the originals of what you have already submitted as copies in the event it is asked for at the interview.

Our officer asked for the tax returns again at the time of the interview. You're supposed to bring everything listed on the interview letter, and if you do that, you'll be fine.

If last year's tax return shows being well above the income requirement, that is all that you need to submit initially. Don't feel like you need to send in three years worth, if last year's is over the income requirements it will be sufficient.

I would recommend having all three years tax information at hand during the interview though, and only give it if asked.

When we apply for the AOS in July 07, we send out the tax for 2006 and we were all above the poverty line. We did received an RFE in Sept and were delayed for 20 days.

I mailled out the tax for the last 3 years. Give them what you have.... it is not worth being delay if you can avoid it.
