Husband does not blieve we need tax returnes

Hi

We are pretty much getting ready to mail out our AOS.

My huband was looking into the AOS today at work and said he could not find any info on the instructions that tells you the tax returnes need to be submitted.

As far as I know I need to submit ones from the last 3 years.

Has anybody got some info on that or a website so that I can prove it to him??

He only believes the government websites the rest are BS to him :(

Section 25:

You must provide either an IRS transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years.

Meaning it's not absolutely necessary to have the last three years' returns.

I HATE miles, gallons, pints, words spelled without u's, and all that other jazz...

Yes - last year's for sure and 2 more if he feels like it. We include the 1 year and have the other 2 if anyone ever requests them but we're well over the poverty line so we doubt it will be an issue

You can do what you want, but there is a high probability your going to get a RFE and get delayed if you do not send in 3 years worth of most current tax returns or IRS tax transcripts for the sponsor. :unsure:

Our IO at the AOS interview told us that the rules changed and that only the last yrs tax return is required. She gave me back the previous 2 yrs that I submitted with AOS. She said she did not want it cluttering the file.

I think the only time you'd submit more than last yrs taxes is, if you were just at the 125% and in the previous yrs you were higher.

Why is that? That is not what the directions say. My co-sponsor is in the U.S. Air Force. I don't think I'll be getting an RFE when it comes to the I-864.

The rules have changed, many people (my husband and I included) sent one year with no issues, since that is what the directions say. :)

Just send the damn tax returns!! What is the big deal...unless he has something to hide :whistle:

If you want to start you marriage off right, ask him these questions:

1) Why he is so reluctant to send his tax returns?

2) Does he even have his Federal tax returns?

3) If he doesn't have them, did he even file his tax returns?

If he didn't even file his tax returns, run..... :blink:

This conversation will most likely result in a nice fight, but hey...better to know what your getting yourself into.

Follow the instructions on the form... In some (many) circumstances only 1 year is required. I doubt there is a high probability of RFE or delay based on this.

It says 1 year is required so send in 1 year. If they ask for more, provide more. It's that simple.

access www.uscis.gov the find form I-485 then Download Instructions for Completing Form I-485 find page 4, number 14. Affidavit of Support/Employment Letter. he have to submit it or you'll get denied if he don't submit his W-2 etc.

Silly Ding Dong? my my my, and disinformation? my, my, my bradcanuck, why risk it or give people a chance for a delay? Then why does it give you the option to provide an additional 2 years worth if there was only the need for 1 years worth then that option would not even be listed there, and if you and FWAGUY and JoeCanuck and MeowMix would read the directions on the I864 it clearly states that by providing 3 years worth of tax returns will help you establish the sponsor's ability to support the beneficiary, the directions even tell you point blank you can try sending one year but we reserve the right to want or demand or ask for more than one year, thus you might want to take our option of sending in three years worth. But bradcanuck, FWAGUY, MeowMix and JoeCanuck go ahead take the shortcut, that is your choice, just wonder how come so many people that do get a RFE for this same thing you claim does not matter end up having to submit and send in 3 years worth of tax returns or tax transcripts in the end, thus just more delays, makes me wonder. But you just keep going on right ahead for you it must be just fine taking the risk.

If you meet certain criteria (one person to sponsor, no co-sponsor), you can just file Form I-864EZ. For both the I-864 and the I-864EZ, you need only submit the last tax return for the most recent tax year (or a statement and/or evidence of why you were not required to file). Like most of the others said, you only need to submit 3 years if the sponsor's income is low and you think it will assist your case.

If last year's tax return shows being well above the income requirement, that is all that you need to submit initially. Don't feel like you need to send in three years worth, if last year's is over the income requirements it will be sufficient.

I would recommend having all three years tax information at hand during the interview though, and only give it if asked.
