Hello all,

According to our timeline our I-130 should have been approved on November 30th. So as suggested, on December 11th my husband called USCIS who almost resented him for calling and told him it's not reached the average time yet so in other words to stop bothering them about it.

I'm surprised nothing is moving but most of all why are there timelines then if USCIS doesn't care about them?

Do any of you have any idea of what could be done next to get answers about our approval?

05/24/07 I-130 sent to CSC

06/27/07 NOA 1

03/10/08 NOA 2

Our I-130 was approved in 291 days from our filing date.

I-129F:

08/22/07 I-129F sent to CSC

09/04/07 NOA 1

03/10/08 NOA 2

Our I-129F was approved in 201 days from our filing date.

Children's I-130:

01/26/08 I-130 sent to CSC

02/20/08 NOA 1

09/10/08 NOA 2 for two of the children.

09/12/08 NOA 2 for the third child.

03/31/08 Arrival in the U.S.

AOS:

I-485, G-325A, I-765, I-131.

05/29/08 AOS sent for Christine and the children.

06/10/2008 NOA 1

07/01/2008 Biometrics

07/18, 23 and 25/08 Physicals

08/30/08 Employment Authorisation (valid for 1 year)

08/30/08 Authorisation for Parole

11/19/08 SSN (valid for work only)

12/04/08 Initial Interview appointment / Rescheduling requested

02/03/09 Interview appointment / very easy, very nice officer, not too many questions, our evidences were enough

02/03/09 Green Card granted for the four of us

02/16/09 Green Cards arrived in the mail

There is a massive backlog on all Service Centers right now.. Due to late filers that filed their cases before USCIS increased their fees..

Hang in there..

I don't recommend TIMELINES right now cause of the delay.. But it usually works out if there is no delay...

IR-1 Visa for Wife

NVC Case Complete = January 2, 2008

Received Packet 4 here in the US (Interview Packet) = January 18, 2008

Case Left NVC Forwarded to USEM Manila = January 23, 2008

SLEC Medical = Jan 31 and Feb 1, 2008 (2 days)

USEM Manila Interview = February 20, 2008 @ 8:30am = DONE! (Status: 2 Months wait is over APPROVED)

CFO Guidance & Counseling = April 17, 2008

Visa in Hand = April 18, 2008 (Our Wedding Anniversary)

Arrival in the US and POE = April 23, 2008 JFK Intl. Airport New York City

Social Security Card = May 2, 2008

Green Card in Hand = August 18,2008

How frustrating. Even with the current backlog, that still seems longer than usual to me. I would definitely call again if you don't have approval by 180 days, which is basically six months. It really shouldn't take more than six months to get from NOA1 to NOA2. Good luck! :)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

Feb 4,2007 - I-130 accepted > Get USCIS case Number NOA1.

May 8 ,2007- GET NVC Case Number > NOA2.

June 16 ,2007- Get Order from NVC to pay 70$.

July 2 ,2007- Get DS-3032 in India.

July 7,2007 - DS-3032 choice of address agent entered in NVC.

July 14 ,2007- Get I-864.

July 18 ,2007- I-864 Enters NVC.

July 29 ,2007- Get Order to Pay 380$ fee.

Aug 3 ,2007- 380$ Fee Reached St Louis.

Aug 25,2007 - NVC & St Louis People receive photocopy of my payment with USPS receipt.

After WAITING for 37 days.

Sept 10,2007 - 380$ fee encashed.

Sept 24,2007 - Receive DS-230 in Mail.

Sept 25,2007 - DS-230 despatched.

Sept 26,2007- DS-230 Delivered.

Oct 1,2007 - NVC has DS-230.

Oct 12, 2007 - DS-230 Reviewed. Case Complete

Oct 16, 2007 - Case at Embassy.

Oct 25, 2007- Interview Letter Despatched from Embassy.

Nov 3, 2007 - Recieved Interview Letter.

February 19, 2010 - Card Production Ordered. Status now IR1

USCIS does not care about timelines because they have nothing to do with them. Timelines are created based on actual data gathered from registered VJer's who input their data into a central database. USCIS has already given you their answer and that can be found on their website under processing times.

The timeline is only a guide for us and USCIS in no way will honor any estimated dates based on VJ's timelines. I know it sucks to be us but hang in there. The wheels are slowly turning but they are turning.

Calling an illegal alien an "undocumented immigrant" is like calling a drug dealer an "unlicensedregistered pharmacist". (because somebody gives a damn)
