Bringing My Son To The USA

Timeline

I am fairly happy with the paperwork required to bring my son over to the USA from a USCIS perspective, however I have a question on the legal side.

I retain joint custody of my son, even though he resides with his mother at the moment, so basically there is no court order saying he has to live with her. Would I need a court order giving me permission to take him out of the country or would a notarised letter of authority from his mother suffice? We have alsways agreed that the childrens welfare comes first and fighting in a court does not represent their best interests. Although it wouldnt be a fight, going to court is just another conveluted waste of time when both parents agree. However if it is required so be it.

You would need permission from the Mother, I do not believe it needs to be ratified by the courts, it has come up before no harm doing a search.
