Hi Guys,

Need your expert opinion on filing Affidavit of Support...

Affividavit of Support requires the petitioner to submit his/her ITR's for the past 3 years. My wife's annual income during the past 2 years was below the 125% poverty line requirement - this was because she was still studying. However, her last and this year's income is way above the requirement. She works full time as a Nurse and is earning 20+ USD an hour. We also do have savings amounting to around 1K++ USD. Do you think this is enough to cover for everything? Do you think we still need a co-sponsor?

Any advice will be appreciated...

are you guys living with somebody else besides your wife?if only by herself and she needs to cover more than 21K annually and if your wife cannot meet that 21k USD then you have to look for co-sponosr so they can support you..check for the I-864 and I-864A form at the USCIS.gov they will tell you exactly what to do..

It'll be just the 2 of us...although we will be living with her parents and her sister for the meantime until we get our own place. We don't need to support her parents and her sister though and my wife earns well above 21K (last year she earned more than that annually and she will earn more than that this year now that she works full time).

I thought it was just 17K++ as per the poverty guidelines posted here in this forum?

Any more advice or any one with a similar situation???

I believe Hawaii and military people are the only exception. For everyone else, a household of 2 means needing more than $17,500 yearly income. Also, the I-864A is used for a household member not a joint sponsor.

Yes, it is just $17,500 for two people. I cannot imagine there being a problem with her being the only sponsor as her income last year and this year are above the required amount. Although the form asks about 2004 and 2005, she should only be required to show her 2006 return. Also, her current situation will count the most in their decision. If there is anything specific to the Phillipines about this, hopefully someone else will chime in. :)

You do need the I-134 for the K-3 interview process; however you only need to meet 100% of the poverty guidelines for the I-134 affidavit of support. You will not need to meet the 125% until its time for the AOS and you will at that time complete the I-864.

Regarding the ITR's for the last 3 years, you should be ok. My friend is in a similar situation in that he didn't graduate university until 2005, so he didn't make more than $10,000 a year until last year and this year, and he had no problems at his interview. I would have your wife take a copy of her school transcripts to show she was in school during the period when she was not meeting the minimum income requirement, and also, I think the letter from your wife's employer and the last 3 months of pay stubs would bear more weight in this situation. It is also my understanding that they take into account things like studying, family issues, economic situations. I think they mainly check the tax returns to check to see if you have asked for welfare benefits prior to your marriage.

You do need the I-134 for the K-3 interview process; however you only need to meet 100% of the poverty guidelines for the I-134 affidavit of support. You will not need to meet the 125% until its time for the AOS and you will at that time complete the I-864.

OK I have a question, but first my story. I was forced into quiting my job last September. As a result I have no pay stubs or evidence of income for the last 3 months, only the money I got from my 401k to hold me over till the first of the year. Although, I have spent about $15000 in upgrades and improvements to the property. I am in the process of doing a owner finiance thing and in the final stages of the contract negotiations for the property.

We have decided to file the I-129F and get this finished because really my wife doesn't need to work and I need her here with me as she also needs me.

Do I need to fill out the I-134 OR the I-864 and do I send this information with the I-129F paperwork and What do I put as income???

Hi guys! forgive my ignorance. Our case was both approved last Nov.8, We got an approval notice and according to my hubby, the instructions and the original copy of that approval notice was sent to the lawyer.

I called USCIS today and asked if they already forward it to national visa center. The guy was really polite however I'm confused with the informayion he gave me. According to him, My hubby has to fille I-824? What was that? Coz our lawyer really doesn't explain much about what 's the next process after approval. She just email some questions regarding the affidavit of support.

Is the affidavit of support urgently needed? Coz my husband is very busy and we thought affidavit of support is only needed when I already have schedule for the interview.

Is it needed at NVC? Can anyone explain to us the process after approval? Are both I-130 and I-129Fbeing forwarded to NVC? What happens next?Is the I-130 being hold? coz we'll go to a k3 route. Is the affidavit of

support needed at NVC together with the I-824?

Hi Guys,

You will need the affidavit of support on the "interview" stage of the process. Correct me if i am wrong, but what will happen is that your approved petition forms (I-129F and I-130) will be forwarded to NVC. Once the NVC has it, they will do some processing and after that it will be forwarded to the beneficiaries' Embassy. Once the Embassy has it, they will send you a packet which you will need to fill up and submit ASAP so that you can be scheduled for your interview. This packet contains all the necessary information and requirements you need for the interview...which includes the Affidavit of Support. The petitioner will need to fill up and send it to you before your interview. You'll only need the Affidavit Of Support as soon as you have your interview. However, this needs to be filled up ASAP as this requires the petitioner to provide evidence (ITR's, pay stubs, certification from employer, bank accounts, ownership of property) which should be done ahead of time. Take note that this also needs to get notarized.

As for which form to use for Affidavit of Support, i have read in the forums here that you should contact your Embassy and ask them which form they use...

No it was more than 21k annually..and if she meet that then there is no need for you to worry and no need for you guys to look for co-sponsor..it will go through as easy as you might think..if you submit all the requirements they need...

Correction, there is no packet three in the Philippines that needs to be turned in for interview scheduling. You will receive packet IV and all documents will be taken to the interview. The interview will be scheduled after the petition is forwarded to the Manila Embassy (USEM). Interview dates can be checked on the Embassy website under IV Interview link on the immigrant visa page.

Hi.. i was just looking into what form I need to file and all documents I need to send my husband now that petition is at NVC (Thank you Lord!). So it is the I-864 right? My dad will be co-sponsor and he will fill one out also. He is retired and also receives disability checks. He didn't have to file 2 of last 3 years. I was told he should write letter siting this tax code (something like that). I'm really not too clear on that. What kind of proof should I/we include to show this income?

Lets see.. I should also include: paystubs, IRS transcripts, letter from employer (with company letterhead)

Is there a form needed to be filled out for any of this besides I-864?

What else?

I'm gathering everything I can together that I think he will need for interview and wanting to send it all DHL one time since it costs so much no matter if its 1 or 5 pounds.

I hope you don't mind me jumping on this bandwagon with my questions also.
