Hello I have been coming in here off and on, and I need yet again your expertise......briefly I have been in te USA for 3 yrs, married for 2 yrs and have 2 american born babies, one non american born I am an Asutralian citizen, my thing is I have overstayed.....and still waiting on my deqare husband to pay for my adjustment papers, to cut a long story short, I have obtained money from my folks and he borrowed it and I am back to waiting on him to pay me back, and among many other reasons I want to leave him, BUT, my question is this, we got married in VEGAS, if we didn't file the marriage through the state is it legit?? is my marriage recognised?? and.......can someone else petition ? eg, my sister In-Law?? If I wait on my hubby I will nvr become self suffiecient or reliant I am tired of having no life or not being able to work or study or even have medical insurance........please help.

Many people marry in Vegas, all quite legally.

Some one else can petition for you, but not a sister in law.

You can study and have medical insurance now.

Your merriage is as legitimate as it can be, the fact that is was in Vegas has nothing to do with legitimacy of your marriage... Anywyas I think that only your housband can file for I-130, and from there on you file the rest of the paperwork (with his signatures for required forms).

March 16, 2006 - Biometrics for I-765, I-485

March 16, 2006 - I-131, I-130 touched

March 18, 2006 - I-765, I-485 touched

March 18, 2006 - RFE for I-485

March 20, 2006 - I-485 touched

March 27, 2006 - RFE sent out

March 31, 2006 - USCIS received the RFE

April 3, 2006 - I-485 touched

April 5, 2006 - I-485 touched

April 6, 2006 - I-485 touched

April 19, 2006 - AP approved

April 24, 2006 - AP received in the mail

April 22, 2006 - EAD touched

April 24, 2006 - EAD approved

April 29, 2006 - EAD received in the mail

May 15, 2006 - Interview letter received

July 12, 2006 - Interview

July 12, 2006 - APPROVED!!!!

August 14, 2006 - Welcome to the US letter and I-130 approval received in the mail

August 15, 2006 - Permanent Resident Card received in the mail

Well, you don't have to wait. You can fill out I-130 for your husband, just have him sign it. You can attach your own check, does not have to be from your husband.

You marriage is legal.

09-02-2005 Applications for AOS, EAD, and AP received by MSC

10-21-2005 AOS fingerprint notice for 12-08-2005

11-07-2005 AP approved

12-05-2005 Infopass appt at San Jose office for interim EAD -- Refused, because it is already approved by MSC on 11-07-2005

12-07-2005 Attempt at interim EAD at San Francisco office -- no go. Back to San Jose, where CSO (chief station officer) tells they will contact MSC via email to request permission to issue interim EAD

12-08-2005 Biometrics for AOS and EAD. Having no EAD appt letter was no problem (used EAD NOA)

12-15-2005 EAD arrived in the mail

12-24-2005 Received interview letter; interview scheduled 03-01-2006

01-28-2006 Received replacement SSN card in married name (5 wks since application)

03-01-2006 AOS interview -- approved; received stamp in the passport

03-13-2006 Green card arrived in the mail
