Timeline

I think I am finally beginning to catch onto some of this! Could someone confirm that if, after getting married, my husband (from Jamaica) and I (US Citizen) file an 1-130 and DS-230 (following all the guidelines), that this process (CR) does not require that we file the I-485 for adjustment of status? I am sorry if what I am asking is not clear, I'm still learning the lingo!

Hey Meliss3108,

Unless it was a fiance visa (K1), you will not be adjusting status. If you have been married less than 2 years by the time your hubby gets approved, you may have to file to remove conditions.

The AOS (Adjustment of Status) would be if you went down the K-3 visa (K-1s are for fiances and K-3 for spouses) route only, and it is not required for I-130 filers. Hope that is what you are looking for...

With the CR-1 visa, which is for couples married less than 2 years, there is no AOS, however, once you arrive in the U.S., you must within 90 before the 2 year conditional visa expires, file for removal of conditions. This would make the sponsored person a permnament resident alien and they receive a 10 year green card. The cost for filing this is, if I remember right, around $590. A big advantage is that you have plenty of time to save for it.
