Regarding K1 !! Specific Case ........Pls Help !!

Hi All ,

I have interacted here to real helpful and kind members here .I hope the group wd help me thistime too ....

I am in USA with a B1/B2 visa and I also met my fiance whom i dated online for 1 and half years now though she is almost 20 yrs elder than me.But we are just one soul. So my question is pls advice whats the way I shd take :

a) I can go back to India and apply for a K1.

OR

B) I can come back again in a business visa after few months and marry her here and then apply for adjustment of status.

OR

c) I can come back again in a business visa after few months and marry her here and then go back and apply for K3.

2nd question is that she earns $ 30,000/yr ( approx) .So wd it be ok for her to sponsor me herself, or i need a co sponsor.( she has no dependent children ) ........

PLease help me with your valuable advices. I am literally puzzled..............Waiting for your replies.....

I am here in USA for the 1st time and we agreed to marry after I got here .before that we were online we were just dating and knowing each other.All of sudden I discovered I can help her in designing her books and making her website with my art background ..... so I came here in a business visa.Here we agreed upon being for each other forever getting married ....... So what shd I do ????Pls help

A ) Yes or you could marry in USA and apply for CR-1 or K-3

B ) No, You indicated "Dated Online" for a year or so, USCIS can interpret use of the B-Visa and adjusting as an attempt to shortcut the normal immigrations visas (K-Visa CR-1), which is visa fraud, it has to do with your intent when entering the country on the non-immigrant visa, if your intent was to marry and adjust, there is a visa for that (K-1).

C ) Yes

And yes 30K per year is more than enough to sponsor an immigrant, NO Joint sponsor needed.

I don't think you can apply for a K1-visa.

If I am not all wrong then you need to be a US Citizen to be able to apply for a K1-visa.

If you are a "Green Card" holder then you can apply for a CR1 but not K1-visa.

Everyone else please feel free to correct or confirm my statement.

I don't think you can apply for a K1-visa.

If I am not all wrong then you need to be a US Citizen to be able to apply for a K1-visa.

If you are a "Green Card" holder then you can apply for a CR1 but not K1-visa.

Everyone else please feel free to correct or confirm my statement.

You are correct it is the US Citizen that does the applying for the actual visa, so his fiancee is the person doing the applying, and yes if fiancee is US Citizen then can be K-Visa or CR-1 visa, if fiancee is only a green-card holder then only option is IR-1 visa after marriage, AOS from non-immigrant is not an option for a NON-Immigrant married to a green-card holder.

All options are on the table but based on your answer, you could, if you want, simply marry here and adjust status to permanent resident. The kicker on that is you must stay here until the green card is in hand. If that doesn't fit your needs, chose the other option that does.

Great answers really .me and my fiance are looking on all options ...... i wd get back soon ........thanks really for the help ........... yes the canadian thing was long ago.I had a Canadian fiance ..but she cheated on me .so I left talking to her .I tried to remove the post from that forum but I cdnt.I am sorry for that .Hope that answers..........I wanted to ask as i did have a possibility....anyways thanks for the replies... i wd question as we have determined what to do ..Thanks all ..............

You could marry while in the country since you had no intent upon last entry, but since you dated online for some time, and you would have to show proof that you did not intend to stay, this could present a sizeable hurdle.

You cannot come back on a business visa in a few months and marry and adjust status, that would be visa fraud because of your intent...you could marry here, return to India, and do K3 or CR-1, or return and do a K1.

If your fiancee has no dependents, 30K will be enough to sponsor you.
