Filing I-129 without I-797..will this work

Hello,

I read some postings about sending in the I-129 prior to receiving the I-797. Seems like there were mixed reviews on whether this works or not.

Does anyone have any definitive answers? Does this work always or is it a matter of luck?

If this does work what do you send? One posting mentioned sending a copy of the post office return receipt that the I-130 had been received at the service center. They also sent in a printout verifying that the Vermont Service Center had received it (not to be confused with a I-797). Does anyone know how to obtain such a printout? Is this something you can go to U.S. post office's website and obtain.

Why not compare visa timing for CR-1 and K-3, in many cases CR-1 takes only a bit longer.

CR-1 is filing the I-130 ONLY, and NO I-129F, CR-1 results in a green-card upon entry, allowing work and other benefits, K-3 requires adjustment of status and payment of a $1010 fee to get (Green-card and EAD), and EAD which takes up to 90 days to get in order to take a job.

You can use VJ to compare the processing times.

Does anyone know how to obtain such a printout? Is this something you can go to U.S. post office's website and obtain.

You are most likely referring to an email return receipt. This is a service you would have had to request when you mailed your I-130. I requested an email return receipt. The USPS sent me an email with the date and time it was delivered and who signed for it.

Since you don't have any timeline information, it is unclear whether you have sent an I-130. If you have not and are sure you want to pursue a K-3, then you should consider sending the I-130 and I-129F together.

However, if you have already sent in the I-130, then you may want to wait out a CR-1 as it has some benefits if you are willing to wait a little longer.

3/19/2008 - NOA2 date -CSC

I-130 held by USCIS for future AOS

I-129F

7/27/2007 - Sent I-129F Package to TSC*

7/30/2007 - Received by TSC

8/30/2007 - NOA-1 - Fee waived

3/19/2008 - NOA2

4/3/2008 - Received by NVC

4/10/2008 - Received by embassy

4/11/2008 - Faxed packet 3 forms to embassy

4/30/2008 - Appointment date assigned

6/19/2008 - Appointment at Bogota Embassy - APPROVED!!!

No touches except when I called CSC directly to inquire.

8/28/2008 - POE Houston

Still being lazy and waiting to do AOS.

*I-130 and I-129F sent together to TSC per USCIS instructions.
