Hello,

My wife (German citizen) is expecting our baby in June. We were married in August and filed the I-130 November 1st. Still waiting for initial notice of action. Have only received registered mail receipt from post office that package was delivered.

Would like to get her here as soon as possible.

Are there any forms that I can file or letters that I can write that might speed up the process to get her to the U.S. prior to having our baby?

Any suggestions, ideas or past experiences?

I don't think that there's anything that can be done to speed up the process, unfortunately. :( Sometimes if the US Citizen can prove extreme hardship on the USC by the spouse not being here then there's some paperwork the USC can file (I forget which one it is!). But, they're a bit unforgiving when it comes to the alien spouse.

I'm sorry to say that it will not be possible. In order to come before the baby is born, she would have to have the visa by April to be safe to fly really and with the new longer wait timetimes for NOA2, it is likely it will be closer to or even past November of next year before she'll have an immigrant visa. Expediting would be for people in the US military who were about to be deployed out of the country.

If you have been a USC for at least five years and have lived in the US for at least five years (two of which after you were 14), then the baby will automatically be a USC and only need a passport to travel with your wife to live in the US.

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

Congratulations for your wife's pregnancy! What you can do is write a letter to the USCIS Service Center where you mailed I-130 and mention your wife's pregnancy and request them to approve your petition as soon as possible. make sure, you include the proof of pregnancy from doctor with your letter, certify the letter so that you can track your mail. Besides that, you can contact your Congressman and Senators and see, if they can advise you anything.

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Yes, you are right. But it does not hurt to write to USCIS, contact Congressman, Senator. If OP gets a quick approval, it is still possible for his wife to come to USA before the due date.

Uhh I feel for you. I am a german citizen married and here waiting in germany for my CR1 visa to come trough

I was in the same situation as you are in right now. I just had our son on October 29th and ..when we started the process it was back in May and I was pregnant and even had a very high risk pregnancy because of complications and prior experiences.

We tried everything...called the congressman...etc...NOTHING. USCIS told us it could not be expedited because Germany was a country with a very good health system and I was taken care of here in Germany as well as in the US.

We also already have a 31/2 year old little girl and she had to go back to the US because I was on bedrest ...they didnt even consider her and us being seperated as important enough.

I would try your congressman, but dont get your hopes up....If I could help you guys with any questions..let me know..if your wife needs someone to talk to that was in the same situation or has questions...I am still here in Germany...I would love to have contact with someone in the same situation.

Keep your head up high...you will get through it...IT IS VERY HARD....my husband has not seen his son as of yet...but we hope to be done soon.

It doesn't hurt, but doesn't help either. There are tons of VJ members also expecting, and none that I know of has had their case sped up because of this. Sad, but true. :(

For expedited processing of K or immigrant visas, that is correct. DOS will sometimes expedite their end or grant a visitor visa for a serious illness of the USC. If it were the USC pregnant and confined to bed rest or something, there might be that possibility but a pregnant intending immigrant is not grounds for any special treatment.

It doesn't hurt, but doesn't help either. There are tons of VJ members also expecting, and none that I know of has had their case sped up because of this. Sad, but true. :(

I know someone personally who wrote to California USCIS three months after NOA-1 that his wife was pregnant and USCIS approved his petition on the very next day. He submitted pregnancy report along with the letter to USCIS. It did not however expedite things at NVC. So even if, USCIS approves the petition sooner rather than later because of the request, it will be helpful. It is very helpful for a wife to be with her husband during the birth of the child.

With all of the back log at VSC and CSC I would not get my hopes up. Because their first trouble will not even be considering to expedite your petition but to find it. Is it still at CSC is it on the way to Chicago, is it in Chicago... is it lost? Who knows at this point. I would hope for you and your wife that you will find a way to be together sooner. But there is not much hope. Hubby and I filed back in August and should be the first waiting in line but even that doesn't say anything about the time that it will still take for our petition to be entered into the system let alone be approved. I seriously hope you find a way because it looks like a very long wait for all of us and even if things sped up now there would be not much hope that your case would be done by April. I am sorry buddy! (F)
