RFE for Medical document

So I applied for AOS in July and got an RFE in the mail yesterday.

I'm a K-1, had my medical in April or May in my home country, entered the US in July.

Apparently USCIS wants an I-693 (not I-693A) from me; I did submit the I-693A in a sealed envelope signed by a civil surgeon with my original application.

They underlined the necessity to have had a tuberculosis skin test or something. The letter also said that it may be that DHS did not forward to USCIS the medical papers I handed over at the POE...

I don't have the full letter here at work to type up in this post but I'm trying to figure out what the hell they want from me.

Thoughts/advice?

Yea, it sounds like the medical exam results were in the envelope you gave at the POE. Did the place that did the exam, by chance, give you a copy of the DS-3025 and if so did you include that in the AOS package? It probably doesn't matter, it sounds like they want a complete exam.

We had the same issue and ended up doing the full medical. Don't waste your time get the full medical done and send it in. Good Luck

I can't believe they did that so long after you filed. You'd think they'd have asked for it a couple of months ago. Sorry they pulled that ####### on you. Good luck.

Ok, now I'm home and going to type up the letter for you to read. Just in case.

Medical Examination (form I-693)

Please submit a properly completed and signed Form I-693, Medical Examination of Aliens Seeking Adjustment of Status. The medical examination must be conducted by an approved civil surgeon.

A review of the record indicates that you entered the US pursuant to a valid K-1 visa. However, the US Dept. of State did not forward the medical forms that were completed prior to visa issuance.

Therefore, you are requested to submit the aforementioned I-693 completed by a USCIS-approved physician. Please be advised that your Form I-693 must reflect that you have had a tuberculin skin test. Current regulations now require that the tuberculin skin test be completed by all applicants 2 years and older blah blah blah blah, if that shows a result higher than 5 mm then you need to have a chest X-ray performed blah blah blah.

So that's it.

It's explicit enough and I don't need clarification on what the letter says. What I'm wondering is if I am, indeed, screwed.

I had the medical before leaving my country, I had the chest X-ray, it all cost me a healthy several hundred dollars, I gave the sealed envelope to the CBP officer in JFK, and it appears that just all went directly to the CBP's waste basket instead of the hands of my USCIS adjudicator(s). And like I said, I submitted the I-693A (vaccination supplement) with my AOS application.

So... am I indeed screwed?

Is this worth scheduling an InfoPass appointment or would they just tell me in person what the letter already says?

I'll abide by the rules but not without a fight if there is a fight to be fought.

So it seems I am going to be able to get those medical forms from the embassy in my home country (I called the doctor who said to call the embassy, so I did that).

However I am now concerned that USCIS will give me trouble because I did not actually send the I-693 they requested, but whatever DS-something form my medical forms from Switzerland are.

Has anyone experienced an identical problem and done what I'm currently in the process of doing?

Or do you reckon it's ok to do?

Something? :-\

  • 1 month later...

Just to give an update to whomever answered this topic or has simply been reading it: I did obtain my medical files in a sealed envelope from the US Embassy in Switzerland, and forwarded that to USCIS. Apparently that worked, because they mailed me my welcome notice today, and I didn't have to do the stupid full I-693!
