This is what happen to me too. That is why my husband decided to submit my AOS package and hopefully i will have my EAD as well.. This is really hard since it seems some offices( states) have different style regarding this matter.

I will take Ninis advice , since am not sure that applying with my maiden name not showing the marriage cert would work , cose even if it would work, wouldnt it be possible I would run into another conflict when its time to change my name to married name and they see the date we got married and the date i aplied with maiden name ( knowing them they will make a big fuss with that ),

I also agrea to send the AOS as fast as possible now , just want to confirm I got the right adresse

When I went back to re-apply for my SSN again a few days ago, the lady I dealt with specifically asked whether I'd submitted documents to DHS showing that I'd changed my name in the system. I told her that I'd applied for AOS about a month ago.

Prior to that, the first time I was at the SSA branch (one week after getting married) they also didn't have problems with the application being under my married name. This was also before I'd applied for AOS.

Nini - Vancouver BC, Canada (she's the one who does the forum thing)

Bee - Devon PA, USA (he's the one who gave her the shiny ring)

Getting our sanity tested by bureaucracy since 2007.

I believe you were mislead. You should be able to apply for an SSN during the validity of the I-94. Go back to the office or try another one.

Yeah you are right she is eligible to apply for SSN, i was denied too when i first applied my SSN at albuquerque because they dont have knowledged i think about K1 visa's. But we tried again to other local SSN office and they give me a letter stating that they are going to verify first my record at the USCIS and it will take 2- 4 weeks to processed. I got mine 15 days on the mail with my married name. But you cant use it for work until you have DHS authorization...

ok we went back to the SSN office yesterday

Now they took my application and suporting documents ( including the print out I showed them )

and said they have to mail a request for change of status to homeland security once they aprove it I get a letter in mail then they would be able to proceed with my SSN ,

I know this is total BS since my I 94 is still valid till feb 10 ,

but oh well am just goin to waite now , if nothing happens I will go back once I have a EAD

( what a bunch of S%$#^ )

They tried to tell us the same misinformed dribble about not being K1 because we were married. They are not immigration experts and often need to be reminded of that. The K1 status is valid for the duration of the I-94. I was not going to let some clerk at the SSA office make the mistake of sending us away without the SSN. We did end up getting the SSN and we got it with her married name.

I have seen many posts saying that people got their SSN after marriage and in their married name with no problem and I have seen many posts saying that the SSA denied the SSN on the grounds that after marriage, K-1 status no longer applies.

Does anyone have a reference to a SSA memo, policy instruction, document etc. that addresses this? Something that I can show the clerk at the SSA office which basically says "according to SSA guidelines, marriage does NOT affect the K-1 status"? After reading dozens of posts regarding getting the SSN, I have not seen any reference to a SSA policy addressing this in either direction.

You probably won't find anything. That's my point -- SSA does not make determinations or policies or instructions regarding immigration status or what changes that status and it would be improper for them to publish any guideline doing so. If the clerk tries to make immigration determinations they are overstepping their bounds.

You may know that he's wrong to make the assumption, and I may strongly suspect it, but what I'm really looking for is something to convince the clerk. Is there anything I can use to show the clerk that K-1 status doesn't change because of marriage (either a SSA or USCIS or homeland security doc) or alternately, something that says he's not allowed to make that assumption unless HE has evidence indicating an automatic change of immigration status?

My wife was also denied her Social Security Card because they stated that since we were married her immigration status changed and her K1 is invalid. They said we needed proof of status change from USCIS (green card). I wish someone would have advised us to get the SSN card before we married saving us all this grief. I cant add to her my credit cards, bank accounts without SSN. She is also not able to work. It's idiotic that a Fiance can get a visa and a spouse is refused. The Fiance has no legal grounds to adjust status until she is married. We are going to wait until she has her EAD (Employment Authorization Document) and make another attempt to get the SSN card. We filed for her Adjustment of Status a few days ago. I spoke with the supervisor at the SSN office and she was of no help.

At least we are together and that's what is most important.
