Hi there folks! As my honey is getting ready for his homecoming :dance: I am trying to think of any last minutes details that I need to take care of....I know from reading previous posts that if entering thru JFK one is able to obtain the temporary employment authorization...my question is if my honey would have to ask for it or present some kind of form or is it issued to him automatically???? any ideas...thank you

Hello,

My husband entered the US via JFK on March 5th and was in fact issued the temporary work visa. He did not have to ask for it, they simply stamped it onto the back of his I-94 stub that was stapled into his passport...nothing fancy or complicated about it in the slightest. Overall, he said the whole process of getting through JFK was pretty simple, quick and easy...best of luck to ya!!!! -weebeansy

When you apply for your AOS (green card), there is a form I-765 Employment Authorization Document (EAD) that you may fill out that grants you permission to work while your AOS is pending BUT the odds of getting that before the temp EAD expires are very, very slim.

dorothy... what everyone has posted is true...

but... just to be on the safe side... have jamal ask for the temp work stamp...

also... i can't remember where i read it... but there was someone who got their temp work stamp... and actually went to work in the states... their temp work stamp expired, and the employer helped them to write a letter (trying to help to get the EAD card) - requesting that the person be able to work until they got the EAD.... and, it actually went in their favor that the employer wrote the letter... just something to try.

good luck!

Lynne

It depends on how quickly you file the AOS paperwork. We filed it a month after getting married, since that's the amount of time it took to collect the appropriate paperwork (vaccination supplement, marriage certificate, etc). DH didn't receive his EAD until the 100+ day from the NOA1, looooooong after any temp EAD would have expired. 99.9999% of the time, the 1 year EAD won't come before the temp one expires.
