Hi All , I am seeking advice , we currently have a LOST I-130 approval somewhere in c.s.c . this has taken 90 days for them to admit and now n.v.c. want a copy of our approval to try and locate it . Well ,my wife {u.s. citizen} has been in the u.k. since oct 2006 ,and has indefinate leave to enter in her passport . Does anyone know if we can apply for d.c.f. ? and continue with the lost application ? it seems that d.c.f. is a hell of a lot quicker than the other route to me . Any advice / comments appreciated ,thanks . I do have a lawyer but seems reluctant to persue this avenue .

With your previous AOS denial, you have a very complex situation and should rely only on information from a good immigration lawyer who knows your whole case. While your wife is eligible for filing in London, I can't advise that you do it without talking to a good immigration lawyer.

US Immigration Timeline

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

With your previous AOS denial, you have a very complex situation and should rely only on information from a good immigration lawyer who knows your whole case. While your wife is eligible for filing in London, I can't advise that you do it without talking to a good immigration lawyer.

I second that. Consult a lawyer before filing - you don't want to risk another denial. Hope things get solved.
