Filed I-130 form to VSC on August 9, 07 and no receipt yet :(

Hello Everyone,

I got married on July 26, 07 in Istanbul and I filed I-130 form for my wife to VSC on August 9, 07. As of today December 2, 07, I haven't got the receipt "I-797" yet...and my check is not cashed either, going CRAZY!!! here. I am aware of the back log but I need that receipt I-797 to be able to file I-129F for my wife, that's what I am reading in the instructions.

My question here is, do I really need the I-797 to submit the I-129F?? When I called USCIS they said yes but here on the forum I read some discussions saying that I-129F can be filed without the receipt, together with I-130, is that true?? Another question.... Is that 4 months we waited count towards the approval time? or time starts when the receipt is mailed? if that ever gets mailed any time soon :(

I filed my on August 7, and VSC received it on August 10th. I did not wait for NOA1 to send 129F, I just sent it along with my Fedex Delivery conformation and the copy of I130 package on August 22 or 23 I forgot. Anyhow, I got NOA1 for 129F and no word on I130.

I filed I-130 on Oct 2, and filed I-129f with just a copy of the check and a copy of the I-130, and managed to get an NOA1. Still have not heard about the I-130.

1/10/08 - Check cashed - yippee!

10/15/08 - AOS documents sent in

1/5/09 - Interview in Dublin

So do you know if they are going to process I-129F right away or are they going to wait for the I-130 to be entered in the system so that they can link those two?

I am in similar boat. I filed I-130 on Aug 20 and my cheque hasnt been cashed yet. My lawyer suggested me to wait for the receipt for I-130 before i file I-129. This process is too slow. Its gonna be 4months for me soon. BUMMER! :angry:

well my husband did send both together... and when my husband called the immigration office and told them he sent both together .. the guy on the fone told him he shudnt have!!!! which i found so weird coz i did read it here too plus so many ppl did it and worked perfectly fine for them..

so a month later we get our i-129 in the mail!!!.... (i sent mine end of september and uptill now i got nothing).... ill wait for the receipt them send in my i-129 God willing.

Yes ?????????, we sent both actually our lawyer did and tis legal as long as it is sent via return receipt required which shows proof of I130 being received - confused more than ever now??

To the OP, if you have waited this long to send your I129F, then there is very little point in actually sending it in. The reason for saying this is because, unless there is a very big delay at the Turkish embassy/consulate when scheduling K3 vs CR/IR1 interviews, then the time the K3 would have saved you is already lost :( And with 4 months gone by, you run the risk of having your I130 approved before they even come across your I129F :(

You will see a lot of people in this forum that are very anti-K3 now because it has no real benefits any longer and only results in a non-immigrant visa and additional costs. Long gone are the days where it would save you a considerable amount of time (except for a few consulates/embassy's where the interview scheduling is vastly different). CR1/IR1 is a better option all around (it's only downside is being an average of 2-6 months longer than K3) and this will probably turn out to be a blessing for you.

There are many of us that sent both applications together and some of us have lawyers and it is becoming a standard practice. AS LONG AS U HAVE RECEIPT OF DELIVERY there should be no problem.

I am still dumbfounded that they sent it back, and more even dumbounded that they had the time to find it.

I'm thinking of firing off my I129, as it has been together and waiting for 4 months for a reciept.

I have the certified mail from the post office receipt and a printout verifying it as recieve on the date form St. Albans Vermonth (VSC). What the hell, can't hurt right? I wish I'd have fired this off sooner.

everything sucks SO ficking bad. Like being on a life prison sentence with no idea of if parole comes up in 1 2, 10 or 20 years. All so unfair to my wife.
