Greetings to all the members of Visajourney. This is my first post so please be patient with me. Last summer was the happiest day of my long life when I married my beautiful Anca in a wonderful service in Bucharest Romania. After spending a wonderful summer together I came back to the States and started this now long a frustrating quest for a Visa. Little did I know that it would take so long. I thought 5 months but NOW it seems like it will be that much just to get a receipt. Vermont recieved my application ( I-130 ) on September 12th but because of the backlog they MAY not get to it until at least December 28th. When talking to an agent of USCIS today I asked about filing an I-129 and she informed me that the processing times were about the same. I am at a loss as what to do and now my Wife is frustrated because she does not know and specifics about time.. I guess I`m looking for some support and good information from people who are in the same boat as I. Thanks for your patience.

Certainly no harm in filing the I-129f but I agree since the I-130 has such a jump start, in all likelyhood the I-130 would be approved well ahead of the I-129f. The CR/IR-1 visa is a far superior visa versus the K-3 simply from a cost and procedural standpoint, that given the option I would take it over the K-3 even if it was going to take a few months longer.

Yes, the wait times have certainly increased for immigrant visa petitions, and it is making for some extremely long waits. :( Try and be patient, do the research, gather your documentation and make sure you're as prepared as you can be for the next step in your journey.

Yes, the waiting time is very difficult. When I was waiting for my approvals some people couldn't believe me that it is possible to be married and to wait so long to be with your husband/wife.

Sent to your wife a link to this forum so she will be aware about the USCIS backlog and waiting time.

I waited 8 months to come to USA and to be with my husband. /K 3 visa/.

In the summer Vermont was quicker than California. It is possible your case to be approved withing 3 or 4 months. Some people have their approvals fast. Wish you to be from them :thumbs: :thumbs: :thumbs:

Welcome to VJ Forums.

The agent was correct in stating that the processing times were about the same at USCIS service centers. The difference in time is at the NVC and possibly the Embassy/Consulate. An I-129f (K3) petion is forwared through NVC in about 3 to 10 days, whereas a I-130 (IR1/CR1) petition takes about 3 to 6 months. You can view the differences in the visa in the links above.

According to your comments it has been about two months since you sent in your I-130 petition, so if you plan to do a K3 you should act quickly. If being together sooner is worth the extra $500 and hassle of Adjusting Status then send the I-129f. This should be a decision made between you and your spouse.

Thanks for the advice. I am wondering now what documentation I should start to gather while I wait. I will be visiting my wife for the X-Mas holidays so it would be nice to know the things I can do while I am there
