Cool, I never called USCIS since I was approved, and never went that route when I was pending. The human you get, is it just a regular CSR or someone at the SC who knows something?

Since jimandjosil have an approved I-130 they could call USCIS using the approved petition option to ask about the I-129f. This option gets you to a human also.

04/16/2007 - Sent I-130 to VSC via USPS Express Mail

05/12/2007 - NOA1 received by snail mail after a loooong wait

05/14/2007 - Sent I-129F for K3 to Chicago Lockbox via USPS Express Mail

10/22/2007 - I129F APPROVED (161 days), I130 APPROVED (188 days)

11/08/2007 - I129F received at NVC, embassy case number generated.

11/13/2007 - I129F forwarded to embassy.

11/18/2007 - 129F petition received at embassy

01/09/2008 - finally, DOS gives me the interview date, April 16, 2007 (ouch)

01/23/2008 - never got packet 4, emailed embassy

04/11/2008 - picked up packet 4, did medical

04/14/2008 - medical report pickup, no problems

04/16/2008 - interview date- APPROVED!!!!!

04/18/2008 - both of us are home at last, POE JFK!

05/21/2008 - sent AOS and EAD

05/27/2008 - received NOA1 for AOS and for EAD

06/02/2008 - received Biometrics appt letter

06/19/2008 - Biometrics appointment scheduled - DONE

06/19/2008 - both AOS and EAD touched because of biometrics

Darn it, I wish I would have known that before. Oh well, I'm done with USCIS. But i just can't leave this forum and go to CR1. It's like getting a divorce from you guys and I'm just not ready to do that :(

Anyway, as for jimandjosil.. here were my details for the K3 as pertaining to the issues you raised (which urge has addressed expertly)...

I-130

6/21/07 NOA1 Rec'd via snail mail

7/16/07 Approved

7/20/07 NOA2 Rec'd via snail mail

I-129F

7/2/07 NOA1 Rec'd via snail mail

My I-129F was rec'd before they approved the I-130 but it was rec'd at Chicago then Missouri then Vermont. I didn't get notice that it was pending at Vermont until September 7, 2007. By then the NVC already had my I-130. They were probably never at Vermont at the same time. I think Urge is right in his line of questioning.. is your I-130 still at Vermont being held for the I-129F approval or have they sent it to the NVC? If they already sent it on, you're probably terminated too.

Not only did I call using the RFE trick and find this out... I called two more times and had it confirmed by a supervisor and two immigration officers. Despite my pleas of mercy they insisted it is policy.

In fact, I argued with them profusely that they were wrong in doing this. One lady there kept saying that I just don't understand what the K3 is for. I asked her to explain it to me. She said that the purpose of the K3 visa is only to have the foreign spouse wait in America while the I-130 is being processed (no sh*t sherlock). Now that I have the I-130 approved there is no need for the I-129F (even if it is still faster with the K3, like in my situation). So I asked her, why then, has it become the trend in the CSC to approve both petitions together. They clearly know the person has the I-130 approved at that point, why continue to work on the I-129F and forward that to the NVC while keeping the approved I-130 at the CSC? She said I am not aware of any such occurance. Of course not. She's retarded. The right hand doesn't have any clue what the left hand is doing. In this case the east coast doesn't have any clue what the west coast is doing. She continued to stress to me that I do not understand that the ONLY purpose of the K3 is to enable the foreign relative to wait here while the I-130 is pending. I continued to insist that explaination may be the intended purpose of the K3 but it is not being treated that way in other service centers or they would NOT pair the two petitions, approve them together, and continue to forward the I-129F onto the NVC. They should live by their own rules. Do you see what I'm saying? She didn't. Maybe I'm not expressing it very well.

Either way, you may not be convinced that these people knew what they were talking about. I am. And i'm not going to waste another day waiting for something that is not going to happen. If I were you, and your I-130 has found its way to the NVC... USE IT. Don't wait for the service center to approve the I-129F when they clearly believe they are not supposed to do so.

As for the baby.. I'm so sorry. I don't know anything about that type of scenario at all. Like Urge said, my son was born in America, we don't have that issue. I really do feel for you being apart from your baby. Everyday is agony for my husband. I can't imagine him having to worry about getting the baby a visa too.

Maybe that is why they are not posting the k3 visa processing time on the uscis website? Maybe that is why they are now waving the k3 processing fee? my 130 went to Cali and my 129F is at vermont. When i check the status of my 130 it just states the received date, despite the fact that i received an approval. Also everyones time-lines talk about being touched but neither of my cases state that they have been touched. i am calling my lawyer to see what he says about this new policy and my case.

i will let you all know what i found out. mercy you can see us both. it really wouldn't be cheating, since you were with us first.*wink

Please keep us informed about what your attorney says, it is so weird for your petitions to be in two different service centers! (at least I think that's weird). Thankfully for you, you have already started the CR1 process. I seriously doubt you are going to get the K3 at the end of it all. Especially since the I-129F is at Vermont and they are the ones that don't think the I-129F should continue on if it's not paired with the I-130.

I wonder if this new "policy" is their mini attempt at trying to catch up on the backlog. They can just collect the money, toss one petition in the trash, work on the other petition and save time so they can all fill their quota for the day and regain a smidgen of pride in the eyes of the world because right now the world is not too happy with them. Did you see the article in the New York Times about them today? I'll retype it and post if for those who haven't read it.

Im going through the same embassy. How about i am supposed to be going to nigeria on the 3rd of this month, and my visa might not be ready in time for me to leave, i spent nearly 3k on expenses for xms and all can you imagine . I wont know until tommorrow when they try to push for an early date so i will get in tme. Also i filed my k3 3mos plus later than my cr1, because i found out also about the long embassy inerview date and nvc stage. i spoke to someone at nvc about this . what if my cr1 gets approved early she said when they start sending me correspondences about cr1 just send them an mail explaining my husband went k3 rte and we will continue once he arrives and will notify them. but she said dont send an email until they start sending me notices about paying etc. she said both will get processed and have to come to nvc just let them know when he gets here so they can finish . Can anyone tell me what can be done if i dint get my visa in time. I guess nothing huh ..

I'm confused about this. Can you please answer a few questions for us?

Has your I-130 been approved and sent to the NVC? It sounds like it hasn't and your timeline does not indicate that it has been approved by VSC yet. If that is the case there is no way you will have the visa at the embassy by December. I'm sorry to have to tell you that. Secondly, keep my situation in the back of your mind. If you sent the I-129F to VSC a few months AFTER sending the I-130 just be careful. The NVC will not know that the USCIS is going to kill your I-129F once the I-130 has been sent to the NVC. I also called the NVC when my I-130 was sent there. They told me they will hold it in storage until the USCIS requests it to be sent back when it comes time to adjust my husband's status once he's in america. They told me that the USCIS has no further dealings with the I-130 until than and they will continue to process the K3. (i was scared back then that they would terminate the K3 and force me into the CR1.. the NVC assured me that wouldn't happen and look where I am now!)

Since you sent your petitions in so far apart this also could happen to you. Just remember, if your I-130 gets approved and the I-129F is still pending, then you get the first packet from the NVC just forget the K3, they're not going to let you have it.

Things are going really slow right now. I don't foresee you getting the visa at the embassy stage by next month. Go to Nigeria, enjoy your stay, kiss your husband a thousand times (and give Nigeria a quick little hello from me ;) ) Then prepare yourself to come home and deal with all this waiting.

If you are going to pursue the CR1 it might be helpful for you and your husband to collect some of the documents you will need to send to the NVC so he won't have to ship them to you later.

i had to read her post a couple times, because it did not make sence. I think she meant her travel visa for nigeria. my passport did not get here until the day before i was traveling. talk about swetting bullets. my friend had someone he knew at the nigerian embasy. he was supposed to be handling everything. so much for that. he probably forgot about it in his back seat.

My friend and I both had that same problem when we traveled back in May. The Nigerian embassy is SLOWWWWWWW lately. I guess I better decide for sure if I'm going in January and apply now!

Sorry no i mean i am travelling there on dec 3 honey, i have not been approved yet i sent my passport for visa renewal so that i can go to nigeria but the damn embassy keep putting it off so they say tommorrow which will be t for me if it does not come through

OOOH call them, bug them, pester them. You'll get it in time. Like Mrs. Jibowu said, she got her's in the nick of time. I got mine a few days before departure. My other friend got hers the day before departure (after calling them a thousand times). I think they do realize your departure date (since a copy of your itinerary is part of the application). Keep bugging them and make them realize you have already purchased your tickets (as per their instructions). Did you send it with a return envelope by UPS or FedEx? you should be able to track it.

I'm sorry for what happened to you , i found this link please read it, can you tell me what did you put on question number 22 on 1-130 form , because a friend of mine put n/a to both lines and his 1-130 was retained here in usa.

no, i went through an agency in washington dc called visa hq and it was suppsed to originally be ready by mon but im leaving on monday and can not change my flight because i purchased from a sale web fare so they are trying to get it ready thursday tommorrow. Everytime i call them they hang up or it says mailbox full. which one did u call whats the #?. I also didn tfile at vermont i filed at california service center maybe no difference huh...

i have not seen much of a difference between centers. As posted in a link several post up, they are moving files from center to center to even out the work load.

mine has been going as planned, but usualy everybody does right up until now. The every ones experience changes from here.

i will always keep my timeline posted.
