Congrats everyone for their approvals. We called 2 days ago to uscis and ... we've been told that our I- 129 will be cancel. :unsure: What we should do ? NVC alreday has assigned case number for immigrant visa , to be honest we are quite confuse.

My timeline is below. I have heard nothing. And aside from the initial touches, I've received no touches. It's just totally depressing coming into the holidays without my husband. It's doubly hard because the lack of progress at CSC with the filers in April, May and June plays on my fears that I won't hear anything until after 2008 has begun. :crying: :crying: :crying:

I'm sorry to read this calamitka. Why did they tell you it would be cancelled? What is the current status of your I-129F? Our case was also one of those not so common, in which the I-130 was approved before the I-129F. I don't understand why USCIS doesn't follows the same procedures with everyone. After our I-130 was approved, they never sent it to NVC (even though the NOA2 said it would be sent to NVC)...they held it until the approval of my I-129F. It was strange that they paired our petitions after the approval of my I-130. You should try calling again, but call through the RFE line, they are able to provide with more specific details about your case.

hi guys!!!

what could this touch mean?

Our case was approved both I-130 and I-129f on Nov. 30. I got touches for both I-130 and I-129f after approval on Dec 02. I checked my portfolio just now and found out that I got a touch for my I-129f on Dec .13., but my I-130 was left untouched. I remember I made a call 2 days ago Dec 12 using the rfe line but she didin't give me any information about the I-129f case because I'm not the petitioner. I'm just wondering if this touch is made because of my call even though she didn't give me information. , or the touch could mean, they already forward my I-129f to nvc/ What do you think? if this is the case, what will happen to my I-130? Anyone who experience the same?

Pechez, sorry but I don't know what it means. Both of mine were approved 11/28 and were last touched on 11/29. Nothing since then.

Just an FYI for anyone who is now waiting to get to NVC: I just called NVC and spoke to an operator who said the MSC number I gave her wasn't in the NVC system. (I assumed it was the MSC number and not the WAC number. Hope I wasn't wrong.) She said to wait another 2 weeks (but then said, "Well, it could take as long as 90 days" :blink: ). I'm still holding on hope that it gets to them in December and that the Embassy gets it by early Jan. at the latest.

Congrats to all the new approvals!

Everyone else, keep the faith. It's difficult, but hang in there. :thumbs:

I just wrote this letter to my brother in law. I thought some of the time lines I cut and paste into the note might be helpfull for you peaches. Actually most of the information I obtained from the K3 forums. My lawyer messed up our K3 by filing it 2 months after our I130 noa1. It got there the day after my I130 was approved.

Here is the information I was telling you about. The USCIS is trying to approve the I129 Petition with the I130. This prevents them from having to process to separate petitions (I129F & I130) with the same information. Thus eliminating twice the work they were doing in the past. So if you get your K3 in before the I130 is processed, the USCIS will put them together and slap them both with an approval.

If both get approved together, the I129F will be forwarded to NVC and the I130 will be sent to the Nation Records Center for storage until you file for Adjustment of Status. This is the policy they announce more than a year ago in this press release: http://www.uscis.gov/files/pressrelease/PN_i-129f.pdf

They had some initial problems implementing this but are now pretty good at it. If both of your petitions were going the NVC, the easiest way to tell would be to look at the NOA2 for the I130, if it says it is being forwarded to NVC, it will be forwarded. If it says you are already in the US, then it will go to storage at NRC, and it will tell you to file the I824 to get consular processing started on the I130.

The I129F will be sent to NVC. This NVC process for the I129F takes about 2 days (but could take up to 5). It only take 1 month to get an interview at the Nigerian embassy.

The NVC processing time for the I130 is 2 months. It take 2 months to get an interview with the I130. So we are looking at Micheal being here around April I the NVC gets our check or the processing. NVC will not touch our case till they get the check.

The average processing time from sent date to receipt of check notice from the NVC is an average of 8-10 days. Today makes the tenth day and the NVC still has not received payment.

Because Michael’s I 129f was not sent till 2 months late the I130 was automatically forward to the NVC with the assumption that we were not filing the I129f. They came to this assumption because no one in their right mind, who is going to go the I129f process , would wait two months to send their petition in. Especially if they are getting profession council from a lawyer. Once the NVC and embassy has the I130 they will not revisit the K3, because they do not want to do twice the work.

If Michael’s I129F petition was at the USCIS at the time they were processing the I130, He would be home with us right now.

Please review the following cases for examples of my information. NOA1 means received NOA2 means approved.

I think that is enough to prove my case. Most of the money for the K3 goes towards the processing of the AOS and the work visa. The actual petition is just a form created out of the information we gave for the I130.

Well looks like we are now going with immigrant visa I-130 was forwarded to NVC and they received this petition and case number was generated. When we caled to USCIS (RFE)they told us that there is new policy.Online status says still pending. Well I don't believe it, indeed the policy says that I-129 will be cancel but when both I-130,I-129 hits embassay.

Yesterday NVC sent AOS bil(afadavid of suport) and Choice of Agent form. If all process will take not more than 3 months it will be great , (no dealing with USCIS with AOS)but I'm afraid it is about luck. lots of luck :yes:

I went past my 180 day mark at least for the I130. My hubby called up USCIS to check if they had any new updates and was told that he has to wait for 30 days before making any inquiry. 30 days include holidays or no? :crying::crying::crying::crying:
