five months and STILL the cheque isn't cashed

Hi,

I'm brand new to this forum, but wanted to see if anybody has any feedback (and happy thoughts!) on my situation. I'm from Canada, and my fiance is American. We sent in our application May 7, and STILL the cheque has not been cashed and we have no case number. Much less anything else. My fiance did get notification (from US Postal Service) that the package was received. This is becoming more and more worrisome to me - anyone have any words of wisdom?

Dec 18, 2007: sent in second K1 application (again! They lost our first one)

Jan 16 2008 : Call from VSC - they checked in application, then lost B's birth certificate (again!)

Jan 19, 2008: New birth certificate (third copy!) received at VSC

Feb 3, 2008: Cheque cashed!!!

Feb 13, 2008: NOA1

Feb 20, 24, 28, 2008: touched

March 13, 2008: touched again

March 18, 2008: RFE #1 received

March 24, 2008: RFE #1 returned to VSC

April 7, 2008: RFE #2 received

April 8, 2008: RFE #2 returned to VSC

April 16, 2008: RFE #2 received

April 17, 18, 20, 21, 2008: touch

April 30, 2008: NOA2 Sent

May 1, 2008: touch

May 9, 2008: Case received at NVC

May 12, 2008: Sent along to Vancouver Consulate

May 20, 2008: Vancouver's got the case now kids

May 26, 2008: Packet #3 received

June 4, 2008: Immigration Medical & Interview Date received!!

June 30, 2008: Interview in Vancouver

August 1, 2008: Arrive in Florida!!

October 11, 2008: Wedding on the beach... finally!

October 13, 2008: AOS, EAD, and I-131 sent

October 17, 2008: Packet received

October 22, 2008: NOA for AOS, EAD, and I-131. Cheque cashed.

November 4, 2008: RFE :( (received and sent back next day)

November 17, 2008: Biometrics in New Orleans

November 28, 2008: Case transferred to CSC - hopefully things will go quickly??

December 12, 2008: I-131 (travel document) approved

Decemmber 17, 2008: I-765 - EAD - card ordered. Hooray!

You need to have your fiance call the service center and see if they can track down what happened to the case. At this point its possible it may need to be resent.

Seems like it's lost. There's no way it takes that long and not cash the check. Have your fiance call them.

Your patience is amazing btw....I can´t imagine waiting this long just to see if they check the cash or not...Definately give them a call and wish you good luck so it gets resolved fast :thumbs:(F)(F)(F)

5 months is definitely an extreme amount of time not to cash the cheque. I sent in my AOS right before the price increase,and it took them 5 weeks to cash the cheque- I thought that was quite a long period of time compared to how long it took them to cash the cheques for our I 130 and out I 824.

I would consider canceling that cheque and resubmitting a new package.

Also- you being in Calgary will mean that your case will go to Vancouver. The Vancouver Consulate is much quicker than Montreal with getting in for an Interview.

At least you have some good news there.

I would say you have a problem. You should try to contact the service center first and if that doesn't work the contact your elected representative. Was the package sent registered or certified?

I agree that a phone call should be made. I would also add that if they have, in fact, lost the petition, that you send them a copy of the signed proof that the TSC received the petition and lost. If you can do that, its likely that they will expedite your replacement petition, if a replacement is necessary! If they give you a hard time, do not hesitate to get yout fiance's congressperson involved. They should be able to help in getting an expedite if it comes to that.

Thanks everyone, for your advice and support.

It's been an interesting week. My fiance did make some calls, and it turns out, our application was very likely lost. Of course, they don't actually say "lost", they tell him that they have been "experiencing some glitches" with the transfer of the system. Apparently they're now working with an outside service provider to help reduce the backlog, and as we know, have 'streamlined' the service centres that are now dealing with the K-1 visa. Since we sent our application to the Texas centre back in May, and now our area is the Vermont centre, I'm thinking that our application might be somewhere around Nebraska? :no:

Anyhow, the supervisor that he spoke to will be sending him a letter acknowledging this 'glitch', and for the system to indicate that it's ok if we have two applications in process at once - just in case they find the old application. No word yet on whether she can expedite the process now that we've been waiting six months (on their error). Nor anything on whether we will be grandfathered in under the old fee, or if we'll have to pay the difference, or just cancel the old cheque and pay the new fee.

Once again, lots of hurry up and wait! Oh well, at least contact has been made.
