still nothing for April filers??

Hi Everyone,

still nothing for us poor people who are still waiting past 180 days?? I got a letter from the Vice President's office saying they will look into my situation and forward it to the Dept of Homeland Security (responsible for USCIS).. they want for them to deal directly with me and want a copy for their records too =) Also, two congressmen have contacted me and is trying to help (nothing from Senators yet.. they are the ones I hear can really help)..

Hello Gogo,

My Senators office is calling USICS tomorrow. The Congressmans office is "suppose" to telephone weekly and USCIS has stated to the Congressman's office we should have a answer at the end of month... I will not let up the pressure until our applications is approved... USCIS is ready to change their dates to May but, we all know there has been approvals for June. So, USCIS NEEDS to APPROVE OUR APPLICATIONS!!!

I just called in and they said my application is not looked at yet.. no notice received... she said that they have a computer glitch recently and will be processing my application "late this year, early next year"... what the hell?? Why can't I get approved like everyone else?? Maybe the ones who are stuck with me are going to be "looked at" late this year... this is so ridiculous..

Who in the world are you speaking to you? Who do these people think they are? I would ask for a supervisor or someone in charge. USCIS has an ongoing computer glitch and someone needs to straighten that whole section out!!!

oh, ok =) You sent the letters to your representatives last month.. no wonder, I sent it just 3 days ago.. and I'm eager to have someone look on my case already..

I am sad now after hearing this news of the "new" glitch... late this year, early next year... could mean from this December to March 2008... oh gosh... :crying: all this time just to get past the 1st step... that is so not fair for us... we are US Citizens and that still doesn't help.. maybe she should just come illegally through the borders... or come on a work visa / student visa.. any of these are faster and can just do the adjustment of status.. is that what they want? the $1,000... here, I'll give them $10,000... just approve it now... I'll wire it over so fast they can't even blink..

Unfortunately, they take their time. But, also the Senators office said we are still within the "Normal" timeframe for processing which is not correct! (These people truely scare me!) Our applications are overdue! But, I also have this "STUPID" RFE that has added more wait time for my applications. Tomorrow our K3 reaches the 6 month mark because of the COMPUTER PROBLEMS at CSC waiting for the NOA from the I-130 to be able to send in and start the process of the K3. I believed you also where delayed because of this... It justs goes on and on....................................... Also, the K3 should have been approved before the I-130 and our I-130 is holding everything up! What the Hell????

I said "Yes".. she said "we are having computer glitch , like you heard before.. we will be able to process your case late this year , or early next year"... she said we will send you a notice of action... I already have ONE!!! what the goddamn hell is going on?? SHE EVEN VERIFIED I SENT MY I-130 IN APRIL!! that is so ridiculous.. so it's been over 180 days already... she told me to wait 30 days for the Notice of Action (I asked her if it was RFE, she said "no") to be sent to my address (she verified that too)...

I don't understand what would the notice of action be? Did you ask them to fax it to you? Something does not sound correct. Basically, everyone else has gotten their approvals from April. Why would there be additional issuies? They are also processing and approving May and June. Does this apply to everyone? Because if this is only targeting April applications this is discriminating and legal action should be pursued! Do you have an Attorney or I would personally telephone one of the Attorneys you have already contacted and explain in detail to them...

thanks My Honey for your offer... =) Actually, I'm planning on sticking to my 1/1/2008 deadline before I decide to sue USCIS... I'm not scared of going to court because I have something to fight for.. I'll bring so many pictures / documents (I'll even tell them to place a call in court to my wife and her family saying it's a REAL relationship).. I didn't try calling my Senators.. do you think that is better than sending a fax over to them? (I sent it to them on 11/13, so like you said, it will take about a month's time)...

I faxed and also sent an email to the Senators office. They took a month and then responded to me by email. I have my own personal email address to the Senators Office in Harrisburg, Pa. I was looking over the website and I was thinking they are delaying you because of the K3, USCIS excuse is because of this:

But, it was not your fault from the very beginning the delay from the I-130 to generate the NOA to send the K3. I bet this is the problem and USCIS will use any excuse to delay an application. I truely believe this!!! Also, I have thought USCIS only has a certain amount of Spousal Visa's they can release for the year. I wonder what this amount is and if this is true?? Have they reached the limit? I can't stand USCIS and there delays!! My heart goes out to you Gogo and its totally unfair and unjustified. But, I really believe this is the problem because of filing after June 1, 2007 and if this is the case. As others are approved I would be documenting the dates and to be speaking to an Attorney! Don't let them push you like that! This is crazy!!

Notice of Action is anything they send you. You got one, NOA1, Notice of Action receipt notice. You should have gotten a Notice of Action Transfer notice for the I129F. The next notice of action should be NOA2, which is your approval. Hope you both get that notice soon.

Is truely not fair practice what has happened! USCIS makes their own rules and we have taken huge hits because of this! There is no accountability when in there system! Because of changing costs with applications and adjusting USCIS procedures we have experienced the impact! Huge problems with not enough staffing and etc. etc.... This is going to be a HUGE IMPACT on ANY filer past JUNE 1st, 2007.

I would imagine now only very few approvals will come out of CSC. The will clean up the back log before June 1st and not process any applications until end of December. Just unacceptable! Also, think about it Thanksgiving and black friday is coming up and they will have time off. Then comes Christmas vacations and the embassy will close for the holidays. USCIS thinks why should we process applications when there is limited staffing for the holidays. So, they will hold and delay applications and are using the date of June 1, 2007 which is 6 months to December 2007. USCIS will then resume processing applications again after the New Year. The bottom line is on the average approval will be 7 to 8 months to complete or longer! (You can tell I'm an Accountant) Well, my friends I have spoke earlier about the delays and I knew it was only going to get worse! We saw alot of applications being approved in a short time ago but, I believe that is finished. Now, it will be interesting what happens next out of CSC........

Also, with all of that said about the delay after June 1, 2007. USCIS is looking at your K3 date and holding your applications because of this.. As in our case USCIS issuied and RFE on our I-130 and is holding our K3. Which SPEAKS VERY LOUDLY!! THESE PEOPLE DO NOT KNOW WHAT THE HELL THEY ARE DOING!!!!!!!!! As for one person they proceed in one direction and other person they do the complete opposite!!! They have NO PROCEDURES to follow; its only how they feel to proceed!!!
