A friend of mine is trying to bring his fiance here. He's not making enuf money (below 21K, which is the guideline). I've heard a rumor that Vietnam Consulate would not pass your interview if there's a co-sign for I-129F, but rather I-130. Is this true?

It varies by consulate/embassy, but having a co-sponsor can make it more difficult for some places.

Unless you and I missed the memo from the State Department, CO-SPONSOR is still an affective policy for Visa application process. HCMC still accepts co-sponsor, sparingly! Don't get "tunnel vision" during this process. Understand how HCMC works is important. Not ONE thing, one issue, one component of your application will decide your Visa approval, it is the totality of your case! How can you tell HCMC that your case is real and remove all doubt with a strong supportive evidence of an on-going relationship!

Answer: No, it's not true, HCMC is still accepting cosponsor, sparingly!

Hi everyone

I'm waiting for P4 now and i'm very upset when i knew that it's hard for they CO approve visa for my fiance :crying: , because my income is not enough for my fiance, and no one can cosign for me...!! My Mom wishes that she can cosign for me but she is retiring now, and my fiance's relative in US - they would like to help me, but i'm worry that the CO will think that our relationship is fake, they will be trict

The reason is my knee's surgery, so i can not go to work for 6 months, so my income is not good in this year :crying: , but i used to be a Soldier in US, and my knee got problem when i was in military ( playing sport), so i still get benefit form militay for knee's surgery right now, some one can help me?? :help:

Your mother does not to be employed to cosponsor your petition, she just needs to show she has a combined income that meet the requirement.

I have been informed by a knowledgeable source that HCMC is now only looking for 1 year (out of the last 3) in which the sponsor made above the 125%. As far a K-1's being able to use a co-sponsor I hear that they will not accept one.

The HCMC Consulate is most concerned about income but they do have to include other assets if you don't meet guidelines for income. At least according to their Packet 3/4 instructions. Currently the I-134 (I-864) only requires one year tax return that shows over $17,500 (Gross Income) for two people to meet guidelines. Does his fiance have a child? Then he needs $22,000. Thi passed her interview on 2/27/08 with my I-134 which had only my 2006 tax transcript and non notarized tax return for income. It was over the guidelines but not by much. I also included bank info and statements because I am self employed.

Also the I-34 (I-864) allows for your fiance to income/assets to consided. If she has a job already in the US, she can show a notatorized letter from her employer that contains the offer of the job, description of the job with why she qualifies for it, how much she will make (including benefits, convert to cash amounts) and whether the job is immediate on her arrival. She has to show the same documents as the sponsor for assets. However I don't know whether the Consulate will agree to use them but it's in the Packet 3 letter instructions they sent to us. The letter also states co sponsors are allowed. And that all of the above can be combined to meet the I-134.

However if you are trying use other means than income, I would contact a lawyer familiar with HCMC Consulate to determine what to do.

Good luck to your friend. I would also suggest he join VisaJourney or at least visit often.

Hahahahahahaha! Now THAT is funny. However, the style of that paragraph seems vaguely familiar. Anyone ever read an owner's manual to a Japanese car or bike made in the 60's? "Beware the evil grease-mud, for therein treachery lies." That is really close to a direct quote from an old Suzuki motorcyle manual, under the heading of "Safety advise".
