Question About Affidavit of Support

Good day everyone!

I have some questions about Affidavit of Support, please. My fiancé and I is on the process of preparing the Affidavit of Support (I-134). We had our petition approved just two weeks ago.:-)

Well here’s the scenario. My fiancé was self-employed for many years until January this year. Then last February 2007, he was hired for a full time job and earning 35K a year. We know that he’s earning more than the required 125% of the poverty level for a family of three. Now our concern is that for the past 3 years, 2 out of that 3, his income was not able to reach the required 125% of the poverty line. We’re afraid that this would cause a problem to my K1 application at the embassy.

Do we have a ground to be worried? Do we need a co-sponsor? Or his being a full time employee now and earning more than the 125% of the poverty level is sufficient enough? We want to be prepared just in case the embassy will be very ####### about his income for the past years and question his capability to support me though his income now has met the requirements.

Your insights will be gladly appreciated.

THE K-1 PROCESS

June 14, 2007: Sent I-129F to Texas Service Center (but case was transferred to CSC)

June 27, 2007: Receipt Notice Date

October 29, 2007: Petition is APPROVED! :-)

December 10, 2007: Case received at NVC

December 12, 2007: Case is forwarded to US Embassy!

January 2, 2008: Pay Delbros for Document Verification

January 8, 2008: CFO Seminar

January 23-24, 2008: Early Medical (Original Sched is Feb. 1, 2008)

February 8, 2008: Interview Date (6:30AM)

February 15, 2008: Received Visa :-)

February 27, 2008: Fly to USA... POE: JFK - New York... :-)

March 14, 2008: Applied for SSN

April 18, 2008: Wedding Day :-)

THE AOS PROCESS

May 13, 2008: Sent AOS docs to USCIS including EAD and AP

May 15, 2008: Package was delivered!

May 21, 2008: Check was cashed!

May 20, 2008: Notice Date for AOS, EAD, & AP

May 24, 2008: Received All 3 NOA's in the mail

May 26, 2008: All 3 cases available online (at National Benefit Center or MSC)

June 12, 2008: Biometric Appointment (USCIS Raleigh - Durham, NC)

June 12, 2008: AOS and EAD touched!

July 19, 2008: AP Approved! Approval is sent!

July 22, 2008: Approval status available online!

July 26, 2008: AP received in the mail!

July 28, 2008: EAD card received in the mail! (With July 19 approval date)

Jan. 13, 2009: Interview Date at USCIS - Raleigh/Durham

APPROVED!!!!

I would agree with ZeeNusah if the word "only" was changed to "primarily". A properly documented $35k annual salary should trump any past issues but you'll need at least one tax return. Perhaps you'll have 2007 ready in time.

Facts are cheap...knowing how to use them is precious...

You should be fine. I was in a similar situation of not having enough income for a prior tax year, but it was fine. His current income should make up for his past earnings.

I think you should definitely provide your 2007 taxes with the I-134 as it will strengthen your case. Depending on where you are in the process, how quickly you will need the I-134, your finacee could complete his taxes online as early as Jan 1. I know most people wait to get their W2 forms, earned interest statements etc. But the information required to file taxes can be obtained from old pay stubs, and most banks, if you use their online banking, report interest earned to date. Be sure to save and print a completed copy of the completed tax return. The free IRS copy will not be available until April. He can go ahead a request the other years now. They will be automatically sent to the last address he used when he filed taxes. If he has moved since then make sure he completes a change of address form from the postal service before requesting the IRS transcripts.

Double check your embassy's requirement. If you are only required to submit 1 year, then take puskbrk's advice and only send 2007. In Ethiopia, I was required to send the last 3.
