Hi everyone

Let me take this opportunity to introduce myself and say hello to all the members. I've been looking at this website for a while now to get some ideas about the fiance visa process, and decided to joint. Everyones posts and comments have been very helpful and encouraging and I hope that as I also go thru the visa process my experience would be able to help someone else aswell.

Okay I am a USC and Nigerian and just applied for my fiancee to join me here. I have sent d applicationa and am waiting for a response. My question is............ My fiance is currently in the UK with a student visa. However, his student visa expired and he has overstayed for about 2 years now (its a long story how that happened). So basically he is in the UK illegally. Will this affect our aplication, as i did not put down this information when i applied, and used his family address in Nigeria? Any advice, opinions, etc would be appreciated. Thanks.

It is NEVER a good idea to lie or omit information during the visa process. You do realize he will be permanently banned if found out, right?

Yes this will affect the petition, I have read cases where consulate denies based on illegal immigrations to a third country.

You need to be honest, worse thing is a waiver will be required, but if you omit anything and they find out, the the immigrant will face a bar.

Here is the thing. 1. if you put down his information in Nigeria, he has to go back to Nigeria because that's where they will interview him and process his case at the consulate level. 2. Many VJ members who have been illegal in the country they are residing in have filed for visas and gotten them. Because they ask you where you reside. They ask you if you entered the country legally. But they never actually follow up on your current status in the country you live in. There was one guy in Canada where they didn't even check to see if he had legally entered Canada. So, the bigger issue is lying. IF you are caught lying on your application, you have a high chance of being denied.

Received AP: 11/17/2008

Received EAD: 11/22/08 (Praise God!!)

AOS RFE: 1/29/2009

AOS Approved: 3/24/2009

Called USCIS 4/1/2009 told no status change and case not yet reviewed from RFE request.

Received green card: 4/3/2009
