Timeline

Must I submit the tax transcript at the interview? Can I just submit copies of 1040 & W2?

If it is a MUST that I submit tax transcripts (which I dont see it stated on the I 134 form instructions) how do I get them and how long does it take to get to me?

Tax transcripts are not required if you have !040 and W2s.

The are a bit more valid tho.

You can get the for free from IRS.

Just Google IRS tax transcripts. 24/7 automaded service. Took about 7 days for me to get.

Get 3 years while doing so.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Thanks! But I dont think I have time for the transcripts. I leave on Friday, Nov. 9th. Has anyone ever been denied because of transcripts?

My fiance brought copies of his 1040 and his W2s and there wasn't a problem at the interview.

Nini - Vancouver BC, Canada (she's the one who does the forum thing)

Bee - Devon PA, USA (he's the one who gave her the shiny ring)

Getting our sanity tested by bureaucracy since 2007.

As long as you have your 1040 and W2s you should be OK. That's all most people submit.

You may be able to have your tax transcriptsf faxed to you . I've seen where others did in a couple days.

Good thing to have.

Timeline

You can submit transcript OR 1040/W2/1099.

The consulates tend to treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864.

In our case this what the I-134 included.

  • I-134 signed and notarized.

  • SIMPLE Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS http://www.irs.gov/faqs/faq1-6.html

  • Photo copy of IRS form 1040, and W2s for past 3 years (Not necessary if you provide the transcripts)

  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.

  • Photo copies of past month or so of pay stubs up to a few weeks before the interview.
My income was well above the povertyline so I did not include any asset data (LIKE BANK STATEMENTS or property values).

Is now a US Citizen immigration completed Jan 12, 2012.

What does your fiance's instructions packet/interview letter say? Did they especifically ask for tax transcripts? Just make sure you bring what the Consulate in Germany asked for, different consulates may ask for different documents.

You can get copies of your W-2's from your human resources department at work. They are supposed to keep them on file for at least 5 years. If you get those for the last 3 years and last 2 paycheck stubs you should be fine.

Are you self employed?

If yes then you need 3 years of tax returns/transcripts

If not then you dont need 3 years, just 1 year is fine. 1040 is fine for thisbut you have other options too like a letter from your place of employment stating your starting data and current salary on company letterhead.

Do you make more than 125% of the poverty guideline for your number of dependants?

If you do all you need is the letter from your employer or your 1040 for last year.

If you do not make more than 125% then you have to show that you have other assets totaling 5 times the difference between how much you make and the 125% for your depentants.

For example:

The poverty guildeline states that for 4 people living in the 48 contiguous states $20,650 is the poverty guideline. 125% of this is $25,813. You, your spouse, and 2 dependant children.

If you only make $23,000 a year there is a difference of $2,813.

In this instance not only do you have to show that you make $23K a year but you also have to show that you have at least $2,813 x 5 ($14,065) in other assets.

These other assets could be your savings account, a stock portfolio, your life insurance, owned property, etc..
