yeh....of course....honesty is the best policy..............always........even if it happened many, many years ago and there is no proof that incident ever happened.....it is always best to come clean..........

Anyway, I hope your situation resolves itself :thumbs:

even if it means being denied a visa or lifetime ban.? that's a question each individual or couple will have to decide for themselves.

ur freakin right! lol... i could be honest sure, but does it really pays off to be honest "for honesty's sake" and in exchange you cant be with your loveone/s in the end coz of visa denial. (unless one has to make an extent which is hard cosidering the economic effect or safety or other issues)... if one is not in a position like this then its easy to say its good to be honest all the time. lol... for me? i dont know for sure but more likely ill do whatever it takes to be with the person i love as long as im not hurting anybody by doing so. :blush:

I wonder if this couple was even aware that this question would be asked or had any idea smoking hooch sometime in his lifetime would cause a visa denial. Did they do any research or retain a competant immigration lawyer and learn the legalities of the visa process? I doubt it very much.

Problem is, those guidelines in the FAM are read in light of the laws of the beneficiary's country I think. While being busted with small amounts of pot may be a misdemeanor crime in the USA, such an infraction may be a much more severe crime in the RP. There is the truth, and then, there is the "legal truth" -- and any lawyer worth his/her salt will say that.

I'd be curious to know what an immigration lawyer would have to say about this. The code that was posted pertains specifically to those wishing to immigrate to the U.S.. I'm wondering if the K-1 is looked at differently since it is called a non-immigrant visa (which, in itself is a bit misleading because the whole process is geared for an intent to change status once they arrive in the U.S. and marry).

I'd certainly recommend to anyone going immigration with past drug use, consult an immigration lawyer before answering any questions regarding their past drug use.

All's I can say if 90% percent of Americans disclosed their innocent drug use in the past on a employment application form.

There wouldn't be many people working!

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship
