I just called in and they advised me to approval the I-129F or I-130?... which is better? She was saying the I-130 is better due to lower fees and same time now as K3...

They said they will send into NVC immediately once I write a letter to them explaining the delayed situation... I got someone's PASS (fax) number... once I fax my letter in, they will pursue whatever I tell them to send in...

Please advise. They said they will hold either one (the one I DON'T want them to foward to NVC)>>>

so basically I get to choose I-129F or I-130... My Honey, you can call in and do the same... they will give you a choice... tell them it's been over 180 days and "very frustrating experience"...

If the representative is good to their word, then that is very good news indeed

USCIS may be taking the same time to approve them but that is not the entire journey. There are several things that you need to bare in mind, in addition to cost.

I130 will take several months at the NVC

I129F will take a few weeks at the NVC

You also need to check your regional forum to find out interview scheduling dates for both petitions. There are some consulates which will schedule a K3 interview many months before an I130 interview.

that is what I told her... she said the "myth" about I-129F being faster is wrong... she told me they are processing at the same timeframe though.. Well, if I wait a couple of months at NVC (wouldn't it equal to my wait for now??)... meaning I was expecting her to come April 2008 anyway, so it would just be the same? (without the need to adjust when she gets here)... only adjust for her green card (since we are married less than 2 years)...

Possibly... but the UK is a fairly straightforward embassy and I am thinking February will not happen for me with all the current delays:

4-6 weeks for NVC to receive and process the file (mid Dec??)

1-2 weeks to process and ship to the embassy (beginning-mid Jan - depending on length of shutdown for xmas)

10 weeks from embassy receipt until interview (currently processing 20th Aug 07 cases)

Nope... February will have been and gone If I even considered the I130, adding a few more months on to that is not something I want to think about

With the I-30 and I-129F being combined they are processed in the same time at USCIS. The difference in time C & J was referring to is at NVC and the Embassy, not at CSC or VSC. The average is 3 to 6 months for a CR1 petition to go through NVC. The time for processing varies at the different consulates/embassies.

I hope this will clear up the myth issue.

Also, we know that if you send in the I130 and I129F they will most likely be adjudicated together. However, if you only send in the I130, would you still wait the same amount of time as if you had sent in both? That is an unknown, but anecdotal evidence suggests that I130 onlys are processed slightly faster than K3s. (see neenuh, and a bunch of VJers that got I130 approvals a month or so before K3s with the same NOA1 dates). Differences in processing times is far from a myth.

If there's any way possible stick with the CR-1.

MUCH MUCH better visa.

I went with the K3 and we now wish we hadn't.

AOS is a BIG and more expensive pain in the butte.

May be a bit slower initially but you will get the GC and SSN way faster and way cheaper than with the K3.

MORE stress and paperwork also.

go with the cr1 and let your spouse arrive here with a greencard... I cannot do the k3 because my lawyer messed up my petition.... I have to do CR1.. but anyway.. at least they will not have to adjust status here

I don' think it is true. People who answer phone calls in most cases are not even familiar with the process. I wonder if they even have biographic info up when you call them and give them your case #.

gogo that is true, i had only applied for I 130 and got my approval earlier than some that applied for both 130 and 129, since USCIS tends to approve them together and waits till the 129 notice date gets closer to what they are processing.

as far as which one to choose , if you dont mind waiting for extra 1-2 months then 130 is much better since your spouse can work the day he/she lands in US , the only time you have to deal with USCIS is filing for 751 after 2 years, on 129 you have to file for AOS in the US.

all personal preferences.
