Would previous denied non-immigration visa affect K1?

Timeline

My fiance (USC) and i have known each other for soon 3 years and I actually spent quite a lot of time with him while I was in the US 5 times on business visa (b1), each time I spent 2 - 3 months - never over stayed. Earlier this year I was accepted by a university in the US so I tried to apply for student visa (F1) to go to that school, however my F1 was refused just because the school is not famous and that I have a BA degree already while getting another BA.. I actually re-tried my F1 and the 2nd time was turned down too in Sept this year.

I am just a bit concerned that this "history" would cause trouble for our K1 application. any idea?

4/27/2009 - received Greencard

No a prior visa denial tends to not affect family based cases.

Also since you will be dealing with Guangzhou China, you will want to Join and research all you can on the China specific board. "A Candle for Love"

I can attest to this also, my husband tried getting a tourist visa before we did the K1 and he was rejected. It did not have any effect on his K1. Although I do remember somewhere in the paperwork asking about previous denials, so you do have to list them.

AOS Approved: 3/24/2009

Called USCIS 4/1/2009 told no status change and case not yet reviewed from RFE request.

Received green card: 4/3/2009

We have a similar story. My fiancee in china applied for an F1 visa in August. It was turned down for the exact same reasons, the school wasn't well known and she already had a comparable degree. Never mind that it was in business instead of english. Anyway, you arn't alone. Best of luck for your Journey.

You'll want to be prepared to answer a question or two about your applications but they aren't a reason for denial. It's difficult to get student visas from China if there is any small reason to expect the application may be fraudulent. This is particularly true for unmarried women. I wouldn't worry about it.

There maybe some questions about your F1 application, in particular if you really intended to study, not just be with your fiance in the U.S. It would be helpful if you have some paperwork from the school you applied to, so you can show that you had a real intend to study there - e-mails from the Admissions Office, letters, receipts... I do not think it will be an issue, however, be prepared to answer those questions.
