My fiancee is trying to get the "official letter" from her ex husband which state that her daughter may come to the United States to live. Unfortunately he sent the letter stating that she can go for visits and vacation. He said that it is ok for her to live here but did not know what to write on the form so he wrote this. Is there a form letter available that she can look at as a reference so he can copy it down for him or send to him? Please help. Thanks. :help:

Of course I put a date on top too.

I faxed it to him and he signed it. They had no problems with it.

Hi Brian,

It's going to depend on the custodial laws of your fiancee's country. If he has no legal custody of his daughter, then you shouldn't need his permission. If he shares legal custody of the child, I'd recommend that your wife find a lawyer in her country to draft up the necessary legal paperwork and then have her ex-husband sign it.

We were fortunate because my wife was never married and Philippine Law gives no custodial rights to the father of the child without him petitioning through the courts for custodianship.

I'd first find out for sure if the ex-husband has any legal custody of the child. Definitely contact a local lawyer where your fiancee resides.
