Hello everyone, Im getting ready to file my petition very soon, I have visited my fiancee in pakistan and we already filled out the paperwork my question is: My divorce is not final yet but will be in next few weeks URGGGGGGGGGG! Does it matter if the Bio325A form is dated before my divorce is final? And we just filled out one copy and then copied the other three but he signed all 4 with his original signature does that matter? Also, the intent to marry, can he fax me a signed copy or does it need to be mailed , it says original i didnt know if that meant that it couldnt be a faxed copy of his signature or not? Any help would be appreciated.

Yes, it does matter. You cannot file until your divorce is final, and submitting the petition beforehand will result in a denial.

One of the requirements is to be legally able to marry.

You need to be legally free to marry before you can file the I-129F.

i know i have to be free to marry, and that i cant file the petition until the divorce is final, I didnt say i have signed the petition, just the bio forms, we already have those filled out and he signed them while i was there, am asking about the date on the bio forms not the petition.

Could be a problem and even more likely so from a high security risk and high fraud country like Pakistan. Why not just get the forms with a contemporary date after your divorce is final? No sense adding potential problems to a process that can go astray a thousand ways already.
