Timeline

Our I-130 was approved in Jan 2007. The NVC has sent our petition back to the CSC even though they are saying they have record of this...

Will my petition expire in Jan 2008 even though it is in their hands and caught up in their cycle of beurocrasy?

Did you file an I-129F for the K-3?

USCIS has been recalling and holding I-130 petitions when I-129F gets filed for the K-3.

Your timeline, and prfile lacks details, did you file for a N/A Visa at the N/A service center?

Hi, yes a I-129F was also file but was not approved until after the I-130 was recalled.

The I-129f sat in limbo for 10 months and had be touched - then after we inquired about it it was approved.

The approval date on the I-129F is officall Sept 18th and to date it has not be received by the NVC.

Our second year anniversary is April 21st- if the I-129 proceeds to the Montreal consulate will I need an interview before then?

You are not required to interview before a specific date.

It can take 2-4 weeks for an I-129F to transit from USCIS to NVC so if USCIS sent the I-129F to NVC it should either be there now or just about to be received by NVC.

Since you say 2 year wedding anniversary, later when you do adjust status from the K-3 you will receive the un-conditional 10 year green-card.

Does it make sense that they would re-call the I-130 even though the IV bill was paid? Nor do does the USCIS have any record of asking for it back. At the info pass appointments my husband has been to, they have told him that the petition is not showing as being re-called, in AP or being re-adjudicated.
