Timeline

Hello, Zhen and I received a K-3 8/8/07. She is here with me in the US. We filed an I-824 in March to have the I-130 sent on to NVC, and it was just approved in a little over 6 months. We are wondering about waiting for the IR-1, or getting the CR-1 as quickly as possible; Medical and police reports, etc. We want to return to China to visit, so the trip is not part of the equation. We appreciate all the help, Mike and Zhen

married in Nanning 10/28/06 I-130 mailed 11/24/06 I-129F mailed 12/8/06

I-130 & I-129F both approved 3/1/07

I-824 sent 3/9/07 K-3 sent to GUZ 3/15/07

K-3 P-3 sent 5/30/07 P-3 ret'd 5/31/07 (P-3 rec'd by mail 6/7/07)

NVC sends email to GUZ requesting Expedite 1/9 or 1/14? DOS says "waiting for interview date" 2/9

You'll save half a grand or so and the hassle of removing conditions if you wait but you'd have to wait a year. Your choice.

i am not sure about the question the IR1 and CR1 are basically the same visa...

you get the IR1 if you have been married for over 2 years.. this leads to the 10 year green card....

and you get the CR1 if you have been married for less then 2 years.. this leads to the 2 year green card.... (you have to apply to remove the conditions in 2 years after receiving this card)

We were thinking that we could get the interview before the one year anniversary of the K-3, and return to the U.S. after our second wedding anniversary, a 3 mo. vacation in China. I am not sure about the police reports and medical exams, but it seams like a possibility. We are looking for help with the pitfalls and possabilities, of this process, thanks Mike & Zhen

Skipping AOS and removal of conditions would require she enter the US using the immigrant visa (CR1 in this case) after the two year anniversary of your marriage but within six months of the visa issue date. So, your interview needs to be delayed until you've been married at least 18 months. If she uses the visa before the two year anniversary, you can skip AOS but not removal of conditions.

Does this fit a workable itinerary?

We were married 10/28/06, K-3 interview 8/8/07, if we have the CR-1/IR-1 interview before 8/8/08, we could wait until 10/28/08 to return to the U.S. I don't remember the expiration time for the police and medical, but they can easily be done again. What other things could we be overlooking? We have the vaccinations book and a health exam report record book, we are trying to decide which path to follow, and we don't want to overlook anything. I hadn't thought about the medical. Police reports are technically good for a year. I'd email GUZ about any medical requirements. I would hope a medical within a year would be good by you'd want to confirm that.

An I-130 is a "petition" which when approved, allows the associated beneficiary to apply for a visa. So, the petition approval being good for a year, means the beneficiary has a year to apply for a visa. In practice, Consular Officers have the ability to extend the validity of petitions.

However, the "year" mentioned in my post does not refer to the petition. It refers to the Police Report and possibly the medical exam.

An I-130 is a "petition" which when approved, allows the associated beneficiary to apply for a visa. So, the petition approval being good for a year, means the beneficiary has a year to apply for a visa. In practice, Consular Officers have the ability to extend the validity of petitions.

I did it, not just once. First time, I read about "visa application" in the guides was on this point: " If the consulate officer approves your relative's immigrant visa application, your relative will be issued an immigrant visa that allows your relative to become a US permanent resident." - but I couldn't find out, at which step it is still a petition, and when it starts to be an application.

The petition is always a petition. When NVC gets the petition, they later send your spouse a visa application.

Have you tried www.candleforlove.com? They have lots of things in Chinese. I can't say about the flowchart. You will have to surf the site yourself for exactly what you want. They also make reference to an automated translation site but I don't think it will work well enough to translate an entire flowchart.
