Hello all..

I would like to ask about something if anyone could help..,

for first im an egyption man,and my fiancee is american,For some circumstances and with the sitiuation of the egyption ministry of justice and the embassy of US in Egypt, our case is kind complicated to marry.

Im thinking of marrying through civil marriage in Egypt, but she is afraid that if we did, it wont be recognized in US and that i will not be able to go there to her in future.

and from another side the idea that [we dont know till when we have to wait the sitiuation to be solved between MOJ and US embassy] make both of us really sick,it could be loooooooooong years if we waited.

however, it seem for me that the civil marriage is the fastest and the best solution for now to be with each other so soon, but she is worry about the case if they didnt recognize it in US.

So,Are there any ideas or solutions could help for going into civil marriage for now and be recognized from US in future??,What is the best ways to make that work??,and What the probabilities of the succeeding toward that matter??

any advise will be appreciate, thanks for help.

yes, I know, and I thank you for your answers. Another user told me to post this here as there are more egyptians/americans in this area that know the specific problem we are facing so I took her advice.Thank you again

Ummm, I don't know about that. There have been a few K-1's that got the temp EAD and by the time paperwork, etc was done to file for AOS, the EAD was expired and it took another 3 months to get it renewed. There was another gal and I that our husbands got here right at the same time, he got the temp EAD, mine did not and once her husbands expired, etc, etc, we ended up getting ours way before he did.

Just weigh out all your options before you decide. Best of luck to you.

If you were planning on applying for a US visa anyway right after marriage, you might as well just apply for the K-1 fiance visa. People say it has a slightly shorter time frame (although I am not sure about that) and you will have no problems getting married when you get here.

If you want to get married right away because you want to live together and wait out the visa process together there, I'm not really sure what to tell you. I guess you could always do the religeous ceremony and then make it legal when you get here, but it would complicate the K-1 visa process.

First, i'm getting confused about what you consider a "civil marriage"....

Second, you have answered your own question that the Egyptian Ministry of Justice is no longer doing the Egyptian/American marriages....and since this kind of marriage is the only authorized marriage that is recoginized here in Egypt or the United States so I guess any other kind of marriage "civil marriage" won't be recognized neither here or in the states or at the consulate level...

Third, i'm afraid that after you go thru what you call "civil marriage" you will have complicated your case as you may loose your chance to apply for K1 visa coz she is no longer your fiance....

so IMO the best option is K1 "Fiance" Visa .........

"marriage" and "urfy" should not be used in the same sentence.

"Orfy Marriage" according to Islamic rules and the sharea'a is considered marriage also under certain circumstance as in the case of the birth of a child and the father denies he is the parent. If this occurs the "Orfy" paper will be used to start a case at the Ministry of Justice to prove that he is indeed the father which is a long drawn out process with lawyers and sometimes hard to prove.

BUT BUT BUT

FIRST ... THE AMERICAN EMBASSY DOES NOT RECOGNIZE THIS TYPE OF MARRIAGE

SECOND ... 9 OF 10 TIMES THE EGYPTIAN MINISTRY OF JUSTICE DOES NOT RECOGNIZE THIS TYPE OF MARRIAGE

THIRD ....WHEN YOU APPLY FOR A K1 VISA YOU SHOULD NOT BE CURRENTLY MARRIED FROM THE PETITIONER

Sharia does not recognize urfi "marriage", but extremist clerics make that claim, which is highly debateable. The basics of urfi "marriage" - secrecy, inequality of benefits, that it is entered into for sexual convenience that can be dissolved by one party w/little recourse for the other, usually the woman - make it comparable to muta, and Sunni law does not recognize muta marriage.

Although such religious claims are made, it is civil venues in Egypt which handle these situations and are still developing laws to try to bring the rights of each party into balance. Yet, it is the women who are abandoned who predominantly bear the social stigma of these arrangements and still fight to legitimize the children they bore. This is not how God's law is intented to work, so no blame for the fruits of vain desires should be laid at His feet, nor should the recommendation to enter into such arrangements be considered valid advice here.

orfy marriage at all,is a secret marriage, and its disrespectfulness from man to marry his girl through it in my opinion,so what im talking about is legal marriage which is recognized under Egyption laws.

I know that the k1 visa will not be our option if we married lagal,my question is if i married her the legal marriage will that going to be recognized from US and then she can file k3 visa or not???

that's why i told you at the first place i'm getting confused about what you call "civil marriage"

now and after you made it clear that your intention is to go thru a legal marriage SO i would say there is no way at this time to go thru a legal marriage between Egyptian/American .

the first thing you will be asked for in the foreign marriage office is the "free to marry" certificate from the American side and since they don't give it out any more SO you better forget about the marriage idea right now .
