I am assembing my package for the K-1 (finally) and I have a question. In the instructions on assembly (#11), it says copy of birth certificate for the US citizen but doesn't say anything about the foreign fiance. I thought I had to send his along too. If so, where do you put that in the packet?

I have copies of both our Divorce Decrees as the last item.

Also, do I need to put in there a copy of my marriage certificate to show going from my birth last name to my existing name (the last name of my ex-husband)?

I just want to make sure I send everything and trying to avoid an RFE. :help:

Timeline

I sent mine today and didn´t send my birth certificate (I´m the alien fiancee). I read all over that is not needed. But just today I read that someone got an RFE for not sending that.

At the same time, I did send my passport copy, and they say that if you don´t have a birth certificate you can send in your passport, so I am expecting that will suffice.

I think it´s up to you, they don´t request for it, but USCIS can be picky depending on the case.

Timeline

We only sent the petitioner's birth certifcate also. Was only aware you needed to have the beneficiary Birth Certificate further down the track but for now, the petioner was all that was required.

We also only sent a copy of my divorce decree and not the marriage certificate. I think they just require proof of the termination of the marriage and not so much any name changes as such.

We sent a letter to CSC to cancel our application. Can't afford repeated air flight tickets to see each other and there's no way we can be apart. Married and staying in Australia :)

Jen, I believe only the petitioner's birth certificate is needed at this stage. If yours is requested, it would be at the interview. Same with the marriage certificate (at least that's how London is).

Well, it was my fiance who sent ours, but I prepared the whole thing for him, just leaving the blank places for him to sign and add his photo and copies, sent it to him, and he fowarded it with the payement.

LOL. I'm also alien fiance doing all the work too. Us determined girls know how to get things done better. I think the process should be equal though on both parts.

I didn't send in my copy of birth cert. and didn't get an rfe for it. never heard of that and never knew they needed it.

I am pretty sure that only US citizen has to send BC with the petition. I am alien fiance and they didn't ask for BC at that point. I will have to bring it to the interview though, on May 09.

And, yes, submit as much evidence of relationship as you can. We got RFE and had to send it back, but it went smoothly after we sent lots of pictures, copies of credit card statements used in same cities on the same date and copies of passport stamps. It is helpful to enclose a lot of evidence.
