Just an update, the immigration of officer my husbands been dealing with - in additional to the hotline have told my husband our I-130 has been shipped back to the NVC on Friday. There is no explanation as to why it was requested back in the first place but I imagine it was an obvious error and part of the K-3 problem.

What upsets me more is that it can take another 30-60 days to REACH the NVC, so that will be a totoal of 4 months wasted because of THEIR mistake.

Hopefully, they will take this into consideration when we request a medical expiate because pf the situation with our daughter given the fact that had this not happened, I would be getting ready for my interview right now.

Well I am glad to hear that someone has your application somewhere! However, as you say, it is disheartening to know that it might take quite a while to get to NVC (hopefully they will send it right away since as you mentioned it was their mistake).

In addition to this, after over a month of calling the NVC to find out the status of out I-129F and being told they didn't have it yet. Today I called and found out that they shipped it to Montreal yesterday...???

The problem is, with the I-130 the NVC schedules the interviews and we where told how to request an expiated interview with them...but Montreal Consulate handles the I-129F and you they only have an automated service.

Hopefully, our contacts at the Toronto location can help us out.

I'd like to add that I am NOT in the US, I am in Canada with our daughter. Our frustration is compounded by the fact that our infant ( who is a USC through her father) has a serious neurological disorder and we are trying to get her into the US asap so she can receive early intervention therapy that is offered by the state.

Maybe this was already asked but...

If your daughter's father is in the US, and your daughter is in Canada but can go to the US without waiting for immigration because she is a USC, then why is she still in Canada? Why not send her down to live with her father so that her therapy can begin right away??

Right now, she is being treated for the seizures with a steroid injection every other day. It requires a nurse to come to the house to administer it and to check her blood presure.

The version of the drug in the US, is different and requires two injections a day and the cost is 100x as much because of a recent price increase. It would cost about $100,000 to treat her with it compared to $1000.00 cnd. Many US insurence companies are refusing to pay the hiked rate.

She finishes the treatment on Nov 28- and can be brought to the US then which is what we will probably have to do but the "EARLY INTERVENTION THERAPY" we want her to receive in the US may have to wait till I get there as my husband has to work during the week. In addition, the drug suppresses the immune system so it's not recommended she be left in daycare, which is what would happen if she was brought to the US now without me to watch her.
