Do I need I134 or I864 or both?

My wife's CR-1 interview is coming up in two weeks. I have already submitted the I-864 to the NVC. The Packet 4 I received asks for the I864 if it has not been submitted to the NVC. Yesterday, my wife went to submit the documents to the VFS in Delhi. They asked for her I134 Affidavit of Support. My wife told them that she doesn't have it so they told her to bring it to the interview with her. I have never heard of I134 being required for my case. There was a mention of I134 in Packet 4 but that was for the people applying for employment visa. I am confused and would appreciate any help. :help:

FORM I-130 PROCESS

Jan. 15, 2007 - Got married in India

Feb. 02, 2007 - Sent Form I-130 via Certified mail

Feb. 05, 2007 - NSC Receives Form I-130

Feb 07, 2007 - NOA-1

Mar. 15, 2007 - Touched

April. 11, 2007 - Touched

April 17, 2007- Approved!!

May 01, 2007- Touched

NVC Processing of I-130

April 27, 2007- Received by NVC

May 14, 2007- IV Bill and AOS fee bill Generated

May 22, 2007- Sent AOS fee bill

May 27, 2007- Received AOS fee bill in mail

June 11, 2007- Received I-864 package in mail

June 14, 2007- Still no IV bill. Called NVC so that they can resend it.

June 18, 2007- Sent completed I-864 package

June 22, 2007- Still no IV bill

June 25, 2007- Finally Received and Paid the IV bill!!

August 05, 2007- Sent DS-230

August 21, 2007- Case Completed at NVC

August 27, 2007- Case Forwarded to Embassy

October 15, 2007- Interview!! Visa approved!!

October 18, 2007- Visa in hand

October 27, 2007- US arrival!!

From reading here on VJ, it is my understanding that different consulates want different things.

If it were me, I would give them what they ask for. The I-134 is not a big deal to prepare, and actually less binding than the I-864, from what I've read. I'd make sure your wife has both in hand (plus copies for your file) when she goes for her interview.

I've read more than one story here where someone tried to challenge some immigration official on a questionable requirement and it didn't go over too well, so unless it's something that would cause you a great deal of difficulty to provide, (or you can't possibly provide anyhow for whatever reason, or something that would actually prevent or delay the visa substantially for no good reason), I'd just do it. I think in this process you have to pick your battles very carefully, and I-134 vs I-864 vs both is not one of the ones worth fighting imho.

Them's my $.02.

well i was just on the vfs site and found out the same thing that i 134 is original is required to submit with all other documents.

i just got done emailing vfs-mumbai hope to find out if its really required or not

Well, all I can say is it also lists the DS-156/DS-156K. The DS-156 is a non-immigrant visa application and the DS-156K is a K-1 visa specific document (NONIMMIGRANT FIANCÉ(E) VISA APPLICATION) so it appears that they have tried to provide an all inclusive list for K-1/K-3/IR(CR)1 visas.

I think that you are right. Actually, I am receiving so much conflicting information about this issue. I have written an e-mail to New Delhi embassy about three days ago and they haven't responded yet. I think that the VFS officials who asked my wife for I-134 didn't know what they were talking about. I-864 is a much better affidavit of support and much more binding so it is required for immigrant visas.

The packet 4 I received asks for I-864, not the I134. The I-134 is only mentioned for the people applying for employment visa. I-134 is much less binding and simpler affidavit of support so it is used for non-immigrant visas. I was looking at the I-134 and most of the things on the form doesn't apply to immigrant visa. For example, one of the places it is mentioned that "the person will maintain his or her nonimmigrant status" and depart prior to the expiration of his or her authorized stay in the United States.
