After fiancee is in the U.S. when can we travel?

Timeline

I know that after your fiance(e) is with you and the U.S., in order to travel to another country, we need permision from the POE officer or somthing like that. But when can your fiancee travel without have to ask for permision.

In my case is this. If everything goes well in October, she comes here in January, and my usual vacations weeks are in July. I want to know if by then we can travel back to Mexico without the POE process..

02/09/09 AOS package send Express Mail

02/10/09 AOS package received and signed.

02/17/09 NOA reciepts

02/23/09 NOA about March 3, 2009 Biometrics

02/28/09 FRE!!!! :(

03/06/09 Biometrics completed

03/30/09 Responded to RFE next day air to Lee's Summit, MO.

04/25/09 AP and EAD card arrives

07/10/09 Interview letter arrives for 8/19/09

08/09/09 AP letter used to re-enter the U.S.

08/19/09 Interview completed. Results in two weeks. ( I think we got it)

08/24/09 Letter in the mail stating Interview Approved. Welcome to the United States!

Once your fiancee is here and you have got married you can apply for Advanced Parole along with her AOS... this will allow her to re-enter the US if you go back to Mexico... once she has her Greencard she will no longer need AP to travel outside the US the greencard is enough....

Do not let her leave the US without the AP or Greencard or she will be abandoning her AOS and will need a new visa to re-enter....

It's not permission from a POE officer to travel outside of the U.S. as it is permission to get back in.

Your fiance will need either her advance parole document or her green card to be let back into the U.S. if you travel out of the country. If you file for them both in January, you should at least have AP by July, so you'll be able to visit Mexico then.

Your fiance (then Wife/Husband) can travel outside the US only after (getting married, of course, then filing AOS/Adjustment of Status) getting his/her green card OR after you file for AP (advance parole) and getting that approved. There is no such thing as permission at POE. Start by reading In This Forum :thumbs:

Your fiance (then Wife/Husband) can travel outside the US only after (getting married, of course, then filing AOS/Adjustment of Status) getting his/her green card OR after you file for AP (advance parole) and getting that approved. There is no such thing as permission at POE. Start by reading In This Forum :thumbs:

thanks guys, i wasnt sure what is called but I had an idea that permission was needed incase no greecard was given yet. She asked my that questions yesturday and i told her i'll find out by asking here. Im sure she'll be happy to know that chances to go to mexico in july are looking good. Thanks for the help! (and that link, too)

When you apply for AOS also submit the AP request otherwise your fiancee will not be able to return to the U.S.

Once you are married, it is possible to apply for emergency advance parole. Just Google "Emergency Advanced Parole" for links to information on this, should the need arise.

I'm not sure what all the criteria are for a qualifying emergency but a friend of mine obtained AP for his wife immediately at a local USCIS service center Infopass appointment based on nothing more than he had a business trip planned abroad and wanted to take her with him, then visit her family on the return trip.

Once you are married, it is possible to apply for emergency advance parole. Just Google "Emergency Advanced Parole" for links to information on this, should the need arise.
