Some quick questions. Im a little confused. (Newby)

Timeline

1. The I129F app states that for proof of citizenship, a US passport is ok if "valid, unexpired U.S. passport that was issued for at least five years."... well mine was issued June of 2001, so would I have to wait until June of 2006 to use my passport as proof of citizenship on a I129F form???

(I think I know the answer, and I think I am not happy about it, since I cant find my BC, and it takes a month+ to get one, if I can remember the information on it to send for a replacement, and above all, I'm not in the mood to wait another month to start this process)

2. My fiancee to be is living in an Apt in Monterrey, NL until she graduates in May, and then would be moving back to her parents home on the other side of Mexico until she can come to the U.S., would it be ok for her to list her parents house as her present address on the G325? which address is used as the "PERMANENT".. the G325 "present address", or the address given on the I129F???

3. Is there any penalty for the K-1 VISA expiring before filing a AOS ?

1R- Your birth certificate , sorry to hear that you have to wait a month to get a new one, can you expedite it?

2R-Yes, she can use her parents as a permanent address, I did that myself.

3R-No, there isn't any penalty, but you have to marry her before the 90th day.

You don't have to have the passport for five years, it just has to be valid, though most U.S. passports are valid for 10 years. In addition, if you use your passport, you need to send in photo copies of everypage.

As for address, use an address where she can be reached. Parents address should be fine, since they problably won't be moving anytime soon. You should also have an address to supply the consulate, where they can mail her her Packet 3 and Packet 4 information. That is the most important address.

So in summation... I can use the passport even though it has been valid for only 4 years 10 months? Also I forgot to mention that I have had a passport for only that time, its the 1st passport Ive ever had.

This statement below is still bothering me though "valid, unexpired U.S. passport that was issued for at least five years." My passport has only been issued for 4 years 10 months... I can wait another 2 months, but Im damn near ready to send this out now.

Also, which beneficiary address do they look at ? The one on the I129F ? or G325 'Present Address?

And about my birth certificate... the one I used to get my passport was a copy of the certified, and the "seal" doesnt show at all... I barely got a passport with it (and this was before 9/11)... Well, that one copy is lost, and to be honest I don't know which information was put down, since my mom uses both her first and middle name at times...Im going to try to send in an App, and hope they give me the benefit of the doubt on my mother's name.

It has to be issued for at least five years not at least five years ago. That means that if your passport has an expiration date that is more than 5 years from the issue date, you are fine and they will be happy to accept your passport.

I assume the reason for this rule is that you could also have an emergency passport that is only valid for a year and lacks certain security features. Normal passports that are presumably difficult if not impossible to forge are valid for either 5 or 10 years. So don't worry about your birthcertificate, copy ALL pages of you passport and use those instead.

Added: The permanent address is the one they will use for all correspondence with your beneficiary (you fiancee). They just want the addresses to make sure that you submit the right police report later on in the process.
