Hey all,

My name is Tom and I've been on the hunt for as much K1 information as possible since I proposed a couple of months back, what I am now looking for is some opinions on my situation as there are no definate yes or nos.

I have been to the USA twice to see my girlfriend, once in november 06 for 2 weeks, then again for 3 months at the very end of April during which time I proposed. Now I've been back in the UK for a while, and the main reason I'm posting is because both times I went out to the USA, I was 'flagged' and my stuff was searched and they asked a LOT of questions.

Now, I'm English, from the UK and there is no way I look suspicious. I did not lie when they asked me what was my reason for entering the states, and I said it was to see my girlfriend. I thought this was perhaps it but many people have done the same and been let straight through.

Either way, getting flagged twice definately isn't good, and while the fiance visa is being processed (for which we are hiring a lawyer) I want to go back out there on a VWP again so that I can see her while it's being processed.. lets face it, waiting 6 or even 8 months to see your fiance is not nice :(

Does anybody see that there will be a problem? I will have proof that I have no intent to get married on this visit (Lawyer bill showing us filing for K1 the right way) and that it's just a case of me not being able to wait so long before I can see her.

You can visit on VWP, however, you will need to bring evidence that ties you back to the UK. Anything from a letter from your employer, to mortgage, to lease.

Having a K-1 in process will likely get you scrutinized much closer than you would normally.

Sorry, perhaps that was not very clear. What I mean is that I will have proof that I intend to get married on the fiance visa, not on this visit on the VWP. I think as soon as I mention fiance they will think I will be going out there to get married, so I would use the lawyer bill for the K1 visa application as proof that I have filed, and I will be returning and entering the US on the fiance visa to get married.

Having a K-1 in process will likely get you scrutinized much closer than you would normally.

I don't think they could scrutinize much closer :P the lawyer said it might be best to not mention the fiance unless it came up, but he also said that depending on when I go out there on the VWP it might be on the system by then that I have filed. So it's kind of a no easy option thing, and I think I might be better to just tell them I am engaged to her, but I am not marrying her on this occasion.

I'm a bit confused, did you file the K1 already, or will have by the next time you go back??

In terms of being "flagged", I am Australian and regularly get the 'SSSS' on the corner of my boarding pass. This means you go through the crazy extra extra security. This has nothing to do with what you say when you go through immigration, happens (supposedly) randomly before you even check in...

You can enter on the VWP, it's completely fine. Just remember: don't lie, but don't offer up any extra info. Have a return ticket and proof of ties to the UK, (a copy of the I-129F packet is a good idea too), and you should be fine.

Hey vanessaandbrent thank you, no we haven't filed the K1 yet, we are literally a day or two away from starting the process (I'm in the UK now).

Nerve wracking, no?? :)

As long as you have sufficient proof of ties to the UK, from what I understand, very few K1 applicants are denied entry.

Have a look at this thread for other member's experiences visiting during the process - it should put your mind at ease! I am going to Florida at the end of next week, I will let you know of my experience if you like :)
