Another (possibly dumb) I-864 question

I'm stuck on question 24, please help. :huh:

We are doing DCF, so my MIL is sponsoring my application, I've just filled out her I-864 for her to sign. B) As my OH was a student and single in the year 2006, he is listed as one of her dependants on that tax return. When it came to filling out his I-864, i couldn't figure out if i'm supposed to put my MIL's income on there somewhere, or somehow indicate that there is another sponsor on the form. Since he's included in her household on her I-864, should I include her and all her dependants on his?

surely there is an obvious answer staring me in the face, I just can't see it.

You're doing DCF and your husband lives with you not with his mother, right? In that case, he should NOT be included on her I-864 as he is not part of her household.

There isn't a place on his I-864 to indicate that there is a joint sponsor. It's only indicated by the fact that you're presenting a second I-864 at the interview.

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

There isn't a place on his I-864 to indicate that there is a joint sponsor. It's only indicated by the fact that you're presenting a second I-864 at the interview.

Either of the answers you've been given are correct but which one depends on facts you haven't mentioned. Your husband had to reside in your country at the time you filed DCF but may currently be part of the same household as his mother. Which is it? Does he live with you in your household or the household of his mother?

yes, we have lived together in the UK for a few years, but he's been on his mums list of dependants as he was a student. This year he won't be on her tax return. So am I right in saying that (since we're not claiming his UK income) his I-864 will just have $0 and it's ok, as long as the other I-864 has enough on it to cover us?

Yes, that is bascially correct. Make sure he is NOT listed on her form. He is not part of her household. It only matters what the current situation is, not the situation in 2006 of him being listed as a dependant.

It's a bit vague on whether or not he should put his current UK income on his I-864. I'm preparing two forms - one with my UK income in USD and one without.
