The second case you mentioned in your original post (August 2 for K3 I-129F... and got approved September... what the hell??) is a little misleading. Although the I-129F for that petition was filed in August, the underlying I-130 was sent in April. It appears that the I-130 was already close to being approved and they simply paired the I-129F and approved them together. So it's not like his entire case was adjudicated in less than two months.

that's true... but both his I-129F and I-130 were "filed" before me... in any case, the USCIS isn't processing the applications in order like they said.. :crying:

There is another I 130 Approval , the NOA1 date for june 5th and approval came on sept 14, check the immigration time lines, so there is sure some discrepency on how files are being opened, i hope USCIS does go by priority date and not just on what they like ...

btw my File date is May 18 and NOA1 is June 6th, i was hoping this month , but doesnt look like ....

just like I predicted... I called them just now and they verified both my I-130 and I-129F numbers and said both were "pending" and was within their "priority dates" processing time... that's a bunch of BS... :crying: I even told them I didn't get a NOTICE DATE or RECEIVED DATE on my I-130.. and asked him if the timeline was based on the NOA1 date, because I got mine on 5/29, even though I applied the I-130 on 4/13... he said "No, not for the NOA1 date... my date would be 4/16"... the day they actually receive the application..

gogo ...just clarifying , the uscis officer told that they process the applications based on when the recieve it and not the notice date correct ?, which means, if i sent mine on May 18th to Nebraska, and nebraska recieved it on may 19th, thats the day they would consider and not the June 6th when the notice was sent out ?

if thats the case, then its little better ..

i agree, i dont think calling customer service would help, they dont know anything and would just go by whats posted on web site, if its taking 6 months they would want you to wait that much before calling them..

i guess we can all pray for some miracle to happen to make USCIS efficient....

yes.. he told me it was based on the "Received Date" and not the NOA1... good, because my NOA1 date was 5/29 (sent to mailbox)... and my received date is 4/16... that's a big difference...

If they were filed before yours then approval before yours is normal. Yes USCIS is processing petitions in order. Read my first post in this thread. Processing and approving are not the same thing because the process has multiple steps and each step can take varied periods of time based on the circumstances of each individual case.

that is after mine too... ... I can't get angry at this one though because it is around my time... but that May one shouldn't have got approved so soon.. it was sent to CSC on 6/11, while mine was already at CSC from 4/16...

At first I was confuse myself about the whole date thing: how does USCIS adjudicate the applicaitons.

I believe the "Received Date" / "Notice Date" has been discussed and debated at lengths in many topics on VJ but from what I can tell after reading some of them and asking a few pro VJers.. Its pretty safe to rely on your "official" RECEIVED DATE..Like u see mine below in my signature.. Usually this is the date that USCIS prints in your NOA1... but I m not saying that they wont go by your received date, if you dont happen to have one in your NOA1...I guess they may just miss to print one out in your NOA1 though they may have it in their record data... I, honestly, dont know how they adjudicate those cases... but regardless, USCIS is NOT a perfect FIFO anyways so overall I dont think this matters TOO much.. We already see a few cases getting approved in a shorter amount of time..I guess we can call them out of order cases then there is Cuban and Military factors (as I call them) then I think there is also an effect of which embassy it will be moving on to..They do more checks, if its a high-fraud country/embassy.. and I m sure numerous other factors involved in getting all of our cases approved.. btw, I am saying all of these just on the basis of what I have been reading on VJ.. I dont have any concrete proof for any of these.. But at the same time I do solely agree that recently we have hardly had any approval from USCIS (both the service centers, I believe) and thats not acceptable either... Anyway, just my $0.02...

that's true, pkewl, but that approval in May was done in the Phillippines... that country is "hot" in the fraud dept, don't you think? A lot of those asian countries (including mine, China) have high fraud rate.. so that doesn't make it fair... I see what you are saying about the "RECIEVED DATE" and "NOA1 Date"... I think there were two dates on the NOA1.. NOTICE DATE / RECEIVED DATE.. the guy told me that my date was 4/16.. even though online it said 4/27... it's one or the other, haha.. but I'll get mad if it was 5/29...

Elbereth, did you get to see your case number at least? It is usually a stamp on the back of the check.. You can request a copy of the check from your bank It usually has EAC, WAC, or (not sure of the 3rd one)... this allows you to create an account online at USCIS.gov and track it (or email too to you if something comes up... like approval or any changes to your case)..

I haven't reach the 180 day mark yet.. it is based on my I-130 NOA1.. but you know what happened?? I got the I-130 NOA1 on May 29 (1+ month later) and it didn't have a RECEIVED DATE or NOTICED DATE... I'm going to grill them so bad it hurts...

as far as we know, our check is still inside an envelop in a mailroom :/

Just to add, don't hold your breath about something being done after 180 days, when my hubby called to ask about this, he was told to call back in another 30 days, just in case they have sent anything out in the post, so by rights, don't bother calling until you are into 210 day of your petiton being recieved at the service centre it was transfered too

gogo: Sorry I dint know it was Phillipines... hmm.. that is kinda surprising then I guess... but for me personally bottom line is that many of these K1/K3 cases are now overdue for their NOA2... I am gettting there personally. What bugs me the most is that there is no accountability whatsoever... USCIS keeps on extending their "official" approval rate AT THEIR OWN WILL and then keeps on telling us (customers) that our cases are in NORMAL PROCESSING.. doh.. ofcourse... Thats like someone extending their own deadline at will to fulfill their own goals.. If I did that at my job then god forbid... I 'd be in so much trouble... but ofcourse we are not talking my workplace but USCIS... Anyways, good luck... and believe me.. I have started to feel the wait anxiety too, which is going to result in my case as a consequence of the recent slowdown at USCIS...

Hi Gogo, I know how you feel but try not to bother about that not in line approval. For me and my family CSC is a big nightmare. You can see from my timeline how long we waited for approval......Now we are waiting again - 35 days and CSC hasn't transfered our petition to NVC yet. Not in line approvals and not in line transfers. I don't know why this happen but wish you luck and maybe your approval is on the way :thumbs:
