Can anyone give me a rough idea how long it will take to get a green card once I have my fiancee visa? We plan on getting married as soon as i get the visa. I spoke with a lady at U.S. customs at the Ambassador Bridge. She told me that once I'm in the U.S. under the visa that I can't leave until I have a green card. Even when I get married to my U.S. fiance I still can't go back to Canada to visit family. She kept stressing that I need a green card to travel back and forth. I'm just wondering how long it will be before I can visit my family? Thanks.

It will likely be 6+ months from when you file for adjustment of status as the green card is not automatic for K-1's.... Interimly you can apply for advance parole (could be 90 days to appoval) if you wish to travel

YMMV

You might take a look at the immigration timelines link at the top of the page, maybe that can give you an idea of what others have been experiencing. Claudeth got her visa in June 2005, came here in July and had her green card in February 2006.

Unfortunately a green card won't be automatic after you get married in the US. You'll have to apply for Adjustment of Status, which could take a few months or longer. If you're looking to travel while your green card is in process, you can always apply for Advance Parole which will let you travel to Canada and back.

AP is included in the AOS fee anyway, so you might as well apply for it in case your green card takes awhile to process.

The fee is $1010 to adjust status, which includes the cost to file advance parole and the employment authorization document. (And I'm so glad GST and PST isn't on there...)

I have a 15 year old son that is on my application for a K1-visa. Does he need to apply for aos also? If so, is it the same cost?
