Marriage in Canada

Hi everybody! :)

I have a few questions regarding marriage in Canada and how U.S. Customs might handle this situation:

1. If an American citizen and a Canadian citizen were to get married in Canada and then wish to honeymoon somewhere within the United States (this goes beyond the continental 48 states, so it includes Hawaii and Alaska and all territories), would there be a problem or some sort of issue with U.S. Customs?

2. Would U.S. Customs think the Canadian spouse was an immigration risk and therefore deny that person entry?

3. How much and what kind of "proof of ties to Canada" would the Canadian spouse need to produce in order to potentially satisfy U.S. Customs?

4. Would the American/Canadian couple go up to the Customs officer together, one at a time, or at completely separate stations? Does it really matter?

my husband and I have both crossed the border numerous times since we were married, both separately and together. Are you going to have return tickets to Canada? There's always the chance that the Canadian will be refused but as long as you have some type of ties to Canada-lease/mortgage, job letter, etc-you'll most likely be fine. We've never been refused but a few people have.

Go through customs together. If they really want to talk to you separately, they'll tell you.

Damn it back to the US process

3/something/2005 finally get NOA2, no idea why it took so long

4/15/07 get case approval from NVC

8/9/07 Montreal here we come

10/14/07 hubby activated his visa

When I was coming back to VA from Saskatoon this summer, a young couple in front of me were going through the K1 process 9I heard them say that to the POE officer) They had no problems entering the USA as a couple.

During our CR-1 process we both visited each other and never had a problem, but we never traveled together. As long as one is honest , has ties to their country, and the POE officer isnt having a bad day, hopefully it goes well.

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

A friend of mine faced a somewhat of a similar situation a few weeks back. He's applied for US GC via employment and his spouse has applied for Canadian GC. They got married in Canada. According to his lawyers once you get married, if your spouse is abroad - all visas are cancelled except for employment based ones. But your situation is slightly different with your spouse being a Canadian citizen .... she shouldn't need a visa to get into the US regardless .... right?

07/09/2007 - Mailed signed copy of I-751 to NSC via USPS 1st class mail

07/14/2007 - Received rejection letter due to not signing original I-751

07/25/2007 - Original application packet and signed copy of I-751 sent on 7/05 returned by the CSC

07/26/2007 - Mailed back the original application packet after signing it via USPS Express Mail

08/06/2007 - Money order cashed by USCIS

08/09/2007 - Receive I-797C Notice of Action with Receipt #

08/25/2007 - Receive Biometrics appt: Sept 7th, 2007

09/07/2007 - Fingerprints and photos taken at Naperville ASC

10/29/2007 - Card production ordered

My husband (USC) and I (Canadian) got married in Jamaica. We flew out of a US city and on the way home we flew into a US city. We cleared US customs together at the airport but did separate declarations b/c we do not live in the same household. Also, being just married ID and airline ticket were still in maiden name. Did not have any problems. Are you planning on flying from Canada into the US or are you crossing a land border? Not that it makes much difference as I think you will be fine either way. Bring you pending immigration file. It will help them see that you do indeed know what you are doing and didn't just get married and assume that the Canadian could move on down to the US.
