I was wondering if anyone has ran into this problem. I was recently married to a very beautiful filipina and I can't wait to get her here. When she picked up the local certified Marriage certificate she noticed that the suffix "Jr" was missing from my name. On the application there wasn't a spot to fill it in but it was on my legal capacity to marry from the US embassy and also on my passport. My birth certificate has "Junior" spelled out and this is causing confusion in trying to get it changed. Is it necessary to get the Marriage certificate changed? Does anyone have any suggestions?

You have to get a joint affidavit to prove that its you or that its the same name of yours.

I plan to marry my filipina fiancee in the Philippines in the middle of October. Can anyone tell me what documents I need to bring? I've been married before so obviously my certified divorce decree. What else? My fiancee said I need a form I think she called it "legal capacity to marry". I'm not sure what that is other than I'm of legal age, single (divorced), etc. If anyone could provide me with either a site or a link on VJ I would appreciate it. It takes time to gather documents and I want to be in the Philippines on October 15th. Also what documents the Philippine goverment would require of my fiancee as well. Any help or suggestions you can provide would be most appreciated. Thank you in advance for your help!

hi there...

when my husband came, we thought he'd need his divorced decrees and birth certificate... but when we got the legal capacity to marry from the embassy, they didnt ask for anything.. we just paid $30, interview and thats it... but to be sure.. bring you divorce decrees if you have been divorced, birth certificate,passport....

Applicants may apply for the "Affidavit in Lieu of a Certificate of Legal Capacity to Contract Marriage" at the Embassy's American Citizen Services Branch everyday from Monday through Friday from 8:00 - 10:00 am.(except Philippine and American holidays). The American must present his/her U.S. passport. There is a fee of $30.00 or its peso equivalent for the affidavit, payable in cash only.

the affidavit in lieu of a certificate of legal capacity to marry;

divorce decree(s) or death certificate(s) required to verify civil status and capacity to marry;

U.S. passport;

documentation regarding paternal consent or advice, if applicable.

May 02, 2008 - visa in hand, had the CFO stamping done at once, bought ticket online...

July 24, 2008 - received package

July 29, 2008 - NOA for AOS and EAD

Aug 01, 2008 - Touched....

just bring your birth certificate, some valid id's, and when you get in Phil go to US embassy and get a legal capacity to marry. after that go to city hall to get a application form for marriage and you have to wait for 10 days for marriage license. thats all good luck and best wishes :D

You will need your divorce papers.

Your passport.

You will have to goto the US embassy and get the legal capacity to marry form.

If your fiancee is not from Manila, make sure you allow for a couple days stay there with her.

After that you will have to goto city hall in the city your fiancee is from.

(NOTE) If there is a suffix on your name such as Sr. , Jr., III, ect ect that it is duley noted on the marrage certificate

and that time or it will be a major pain to change later.

Depending on her age you may or may not need a letter from her parents giving their approval; at the city hall.

If she is under 21 years you will need this when you arrive.

Also most places require her to take a compatibility test at that time.

And some require counseling. When you have the marrage certificate approved.

It has to be posted for 10 days. After that you can marry your Fiancee.

Jan 10 2007 got receipt and case number!

Jan 12 2007 sent 129F

Feb 6 notice they were moving the file to a faster service center.

Feb 26 Notice of I130 approval

Feb 28 2007 notice they were sending 129F to USCIS for further investigation (err #######?)

May 15 2007 notice of approval of 129F with processing dates of 05/15/2007 thru 09/14/2007

May 28 2007 Notice from attorney that NVC needed processed and money orders were needed.

June 4 2007 Traveled to Manila to spend 2 weeks with my wife!! (YeHaaaa!!)

Fed-xed her signed papers (For NVC) from Manila to attorney from Manila while on vacation

June 18 2007 Nvc approved support.

June 29 2007 packet arrived @ my home informing of interveiw for I130 on Aug 27 2007 and explaining Medical interveiw.

(Note wife never received packet for I130 in Philippines I fed-ex'ed mine to her for medical interveiw)

July 17 2007 packet arrived for 129F setting interveiw for Sept 5 2007

August 5 2007 Wife flew to Manila for medical interveiw on August 6.

August 26 wife flew to Manila for I130 interveiw on August 27 2007.

August 27 2007 12:31 pm I130 Approved

wife arriving Nov 18th

WIFE ARRIVED Nov 18th!!!!

To the OP, clueless - I am sorry I do not know how you would go about changing the marriage certificate, but USCIS will want it to say Jr or Junior. Without one or the other, it's actually your father's name and so not technically legally binding to you.

How interesting. I wasn't aware of that possibility.

Not sure how that changes anything in the instant context but I think if the marriage certificate supplied with the petition has the other vital information like birth date and perhaps birth place of the husband, the USCIS will accept it as proof that John Michael Smith Jr. married the beneficiary, even if Jr. is not included on the certificate.

Facts are cheap...knowing how to use them is precious...

Have your wife check with the Local Civil Registry who issued the marriage certificate. Hopefully, she can talk them into correcting it.

We found mistakes on our marriage certificate before the pastor signed it. My wife had to get another certificate with corrections, then have all the ninongs and ninangs resign, have the best man and maiden of honor resign, FedEx it to me to sign, then takeit to the officiating Pastor to sign, and then turn it in to Civil Registry. It was time consuming.

Just to clarify, that is 10 Filipino working days or two weeks. Add another day if there is a holiday on a week day.

Just to clarify, that is 10 Filipino working days or two weeks. Add another day if there is a holiday on a week day.

Is there anyway to apply in advance via mail? I'm not sure I can get two weeks off. But I don't know for sure. It would be nice if application could be applied for in advance of my travel.
