Difference between IR1 and CR1

I just want to know whats the difference between IR1 or CR1. I filed I-130 for my wife and the form doesn't indicate anything about IR1 or CR1.

I am trying to send the AOS Fee bill using James Shortcut and it asks for Visa Classification and i wanted to know if i should put down IR1 or CR1.

Please someone shed some light on my issue.

Aug 09, 2007 - NVC Received Package from CIS

Aug 20, 2007 - Generated DS 3032 and AOS Bill

Aug 21, 2007 - Emailed DS 3032 to NVC (Used James Shortcut)

Aug 22, 2007 - Sent AOS Bill overnight (Used James Shortcut)

Aug 28, 2007 - NVC Received AOS Bill (Automated Voice message)

October 15, 2007 - NVC Received AOS and DS-230 Forms

October 24, 2007 - CASE Complete

November 2, 2007 - Case at Embassy

January 10, 2008 - Interview Date

January 10, 2008 - VISA APPROVED

Put down CR1. IR1 is issued when the couple has been married two years at visa issue time. IR1 visa holders get the ten year green card. Those are the only two differences.

Put down CR1. IR1 is issued when the couple has been married two years at visa issue time. IR1 visa holders get the ten year green card. Those are the only two differences.

Actually, CR-1 visa holders can get the ten year green card, too, if the dates work out right.

Note that the IR-1 vs. CR-1 decision for the VISA gets made at the consulate on the day the visa is issued. The process is identical for both visas, and some of the early consular paperwork is a bit loose regarding the distinction, because there really isn't a distinction until the day the visa is issued. If the marriage is over two years old when the visa is issued, it's an IR-1; if the marriage is newer, it's a CR-1. If you're close to the line, a slight delay in the issuance of the visa can change the visa type -- it's ok, they don't need to redo any of the early paperwork.

When you enter the US, they take a second look at the age of the marriage. If it's over two years old on this date, you get a ten year card with no conditions; if you've been married less than two years, you get a two year card with conditions. The entry date is the important one for determing which kind of green card you get and whether you'll have to go through the whole removal of conditions process.

If you get the visa just before your second wedding anniversary and enter the US after your anniversary, you'll get a CR-1 visa and a ten year green card.

To the OP; take your best guess at which visa you'll get based on the age of your marriage, but don't worry about it. They'll accept either answer and they'll sort it out on the day they issue the visa.

19 Apr, 2004: I-129F Sent to MSC

29 Apr, 2004: I-129F NOA 1

13 Aug, 2004: I-130 Approved by CSC

28 Dec, 2004: I-130 Case Complete at NVC

18 Jan, 2005: Got the visa approved in Caracas

22 Jan, 2005: Flew home together! CCS->MIA->SFO

25 May, 2005: I-129F finally approved! We won't pursue it.

8 June, 2006: Our baby girl is born!

24 Oct, 2006: Window for filing I-751 opens

25 Oct, 2006: I-751 mailed to CSC

18 Nov, 2006: I-751 NOA1 received from CSC

30 Nov, 2006: I-751 Biometrics taken

05 Apr, 2007: I-751 approved, card production ordered

23 Jan, 2008: N-400 sent to CSC via certified mail

19 Feb, 2008: N-400 Biometrics taken

27 Mar, 2008: Naturalization interview notice received (NOA2 for N-400)

30 May, 2008: Naturalization interview, passed the test!

17 June, 2008: Naturalization oath notice mailed

15 July, 2008: Naturalization oath ceremony!

16 July, 2008: Registered to vote and applied for US passport

26 July, 2008: US Passport arrived.

This is great info. At least your posts above asnwered my question regarding the whole CR1/IR1. But anyhow, I had prepared a letter to the Consular when my husband gets his interview at the US Embassy in Manila, to ensure they don't overlook our 2nd yr anniversary date, which will entitle my husband of an IR1 visa.

That isn't always true. Yes, it's the way it's technically supposed to happen, but not every POE officer knows that or follows it. So the immigrant would have to be very specific in requesting it and pointing it out.

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly
