IMO if someone had used my identity to get married I would be going to the police to have them arrested and get this fake marriage nulled.... I would not just apply for a divorce and go ahead with it.... if I did not get married then why would I need a divorce.... are you sure she is telling you the whole story.... because if it raises red flags to us just imagine what it will do when she has to go for an interview......

My fiance's auntie somehow married my fiance to another man from the states without her even knowing it back in 2004, around the time i first met my fiance. This was done for the aunt's personal reasons as no one in her whole circle of family knew about the marriage. We were getting ready to file for the K-1 visa a few months ago, but got lucky and found out about the false marriage. To make a long story short, the guy agreed to file for divorce, and that completed just a couple of weeks ago, so we can now start the visa process. I wanted to get the marriage annuled but that would've been a more lengthy and more costly process.

My question is will this pose as a problem when it comes time for the interview or when they are reviewing the paperwork. Because they will notice she got married in 2004, but my statement will say we met around that time and started our relationship. I'm thinking it's best we just come open w/ all this so we dont have to hide anything from them; we'll state on the papers what exactly happened and that my fiance never knew about the marriage. If we do this will anyone get in trouble?? We have the marriage certificates, and my fiance's signature is not really hers. What I really want is to get her here as soon as possible w/out any problems & w/out anyone getting in trouble. Any advice?

It's true it's a very awkward situation but i've talked to some laywers and everything will be all right. Honey noone is bashing you or your fiance' the fact of the matter is that people LIE to get into the USA. And I am sorry but your case is very uniquely suspicious. And if you come to a forum where many people have had fiance's that have lied to get into the usa don't expect everyone to be like wow she is telling the truth. Can you blame us for being brutally honest? But to react to bashing by bashing is no way to take out anger. If your case is as you say it is which I will admit I am still very doubtful. Good luck to you and your fiance and I wish you all the very very best in life. But as I learned on this forum don't expect everyone to see eye to eye with you.

Hey now.....I was nice.....all I asked was what did the aunt gain from her part in any lies. I'm still unclear on that one..............Are you saying she stole her niece's identity for her own visa use? Or was there some other gain to be had?

Any way you look at it, I do wish you luck in this. It does sound kind of fishy to me, as well. And, I would forge ahead with much caution. But, if you honestly believe in her, her story, and you as a couple, I wish you the best of luck in sorting this all out and your future together.

this is a great site to get advice , you ask for advice people here gave advice ,

it has nothing to do with bashing they told the trueth , and if you belive it was bashing and get upset over people you dont even know when they give advice ,

how will you react when the consulate ask more demanding questions , your question was will that be a problem for your case ,

you say she got divorced in the states , well i wont and cant compare my situation with yours ,

but plz listen to everyone get a laywer , I was married ( got married in germany ) after moved to canada , many years later got divorced in canada ,

then found out had to file trough the german consulate to get the divorce in germany legalized and registerd too , had I not filed for it I would have had trouble to even marry again since that would have been considert polygami ( or how ya call that thing )

to make a long story short , you should contact a layer I dont know the law but if the law is the same as it is in germany , and she got a marriage certificate from the phillies and divorce in the states , she might have to file for the divorce to be registerd in phillie as well , before you marry her , if she doesnt your marriage wont be acknowlaged since legaly she is still married in philli ( but how can she be legaly married if she was never legaly married to begin with , but maybe a laywer will be able to get better answers and as to the divorce registration laws in philly too , anyhow good luck

...not to mention that the original post makes no sense. How you you get married without your knowlwdge?? Who took out the marriage license. Who were the witnesses. How did some court in the US acquire jurisdiction.

I would never get into a divorce situation for a marriage that I knew nothing about nor acknowlege that it ever happened. How was the fiancee served by some court in the US to acquire jurisdiction??

Wish you the best...but I think that you need to talk to a US family lawyer and have a copy of all the papers in your hand when you do.

i think you have to understand that this is all just alittle too much to believe. And the easy one to get the info from is your fiance since she can get all the details from the aunt. but not many details do you or her seem to know. It all seems so foggy.

1. you fiancee was married but doesnt know it.

2. she came to the USA on a "RARELY given tourist visa. that alone puts her in the 1% top of all filipinos

3. her aunt somehow married her off while she was here and forged her name on the marriage certificate. no info is given on who attended or if you fiance was there. If that is the case, why did she leave? why didnt she adjust status and stay in the usa? If she went back was the guy doing K1? why would the guy marry her and then do nothing to get his wife to stay with him?

4. it doesnt show up on the Cenomar. is she married? is she single?

5. her "husband in the USA" grants her a divorce and pays for it though they have never really been married or together?

all this piled together says either you havent posted all the pertinent facts or your fiance isnt telling the complete story to you and is thus not being honest. And i can tell you for sure, the embassy will ask much harder questions then were asked here. i hope you have a very good attorney. ive seen many tell the filers that their girl will be in the usa in 2 months tops. Some of them give bad advice. i hope the one you have is on the mark and you get thru everything with no problems. No one here wishes you bad things. in fact most are concerned for you getting taken. maybe you could step back and look at it and then see why people here are seeing red flags everywhere.
